Item UNELE CONSIDERAȚII PRIVIND TRĂSĂTURILE DREPTULUI ADMINISTRATIV(CEP USM, 2024) Țurcan, LilianaIn this study, the opinions regarding the features of Administrative Law presented in the specialized literature are examined. It is found that there is no unique view on this subject, the number and content of the features being different from one author to another. Some of the peculiarities of Administrative Law are subject to criticism, having an outdated character (for example: the impossibility of codifying this branch of Law). Identifying these features allows us to better understand the place and the importance of Administrative Law in the unitary legal system.Item HOW PBL CAN INCREASE THE EFFICIENCY OF EDUCATIONAL PROCESS AT LAW SCHOOL?(Tipografia Sinectica-Com SRL, 2017) Țurcan, Liliana; Zamfir, Natalia; Vidaicu, MihaelaThis articles aims at providing the approach towards problem based learning at Moldova law schools. Taking into account that current law schools’ curriculum contains several elements of problem based learning, authors of this article provided examples of specific interventions used in teaching several braches of law. In particular, authors described the use of individual research projects for administrative law, a group project for constitutional law and solving a practical issue for environmental law. Authors emphasized the need for problem based approach for other branches of law as well taking into account the specifics of legal studies and the need for including skills based courses in the university curriculum. Moreover, authors came up with a list of recommendations to facilitate introducing of the problem based learning at law schools.Item CARACTERISTICA GENERALĂ A CONTRAVENŢIILOR ÎN DOMENIUL INFORMAŢIONAL(Tipografia Artpoligraf, 2018) Țurcan, LilianaThis article has as object of study the contraventions in the informational field, the circle of which is constantly increasing in the last period. The main features of this group of contraventions are identified. The elements of the legal composition of the contraventions in the information domain, as well as the specific sanctions applicable to them, are examined. Similarly, the circle of state subjects, which have the right to ascertain and examine the contraventions in the given field, is determined.Item ROLUL COMBATERII CONTRAVENŢIILOR ÎN DOMENIUL PROTECŢIEI MEDIULUI ÎN ASIGURAREA DEZVOLTĂRII DURABILE A ŢĂRII(Tipografia Artpoligraf, 2018) Țurcan, Liliana; Zamfir, NataliaThis article aims at providing the approach towards developing the contravention liability in the environmental area in the Republic of Moldova. Taking into account the character of national interest in environmental protection in ensuring of sustainable development, adoption of the new Contravention Code included the legal provisions for solving gaps of the previous Code. In particular, authors described new contraventions against the environment, their specific features. The performed investigations allow the authors to argue the need for a comprehensive reform in this domain. Authors emphasized the necessary to elaborate and adopt the amendments in the Contravention Code for series of illegal actions or inactions for environmental damages not currently provided in the light of the transposition of the EU Environmental Directives.Item ROLUL TI ÎN APLICAREA METODEI „ÎNVĂȚĂMÂNT BAZAT PE PROBLEME”(Tipografia Artpoligraf, 2018) Țurcan, LilianaThis article has as object of study the problem-based learning method and the role of information technologies in its application. The main issues related to the application of the "problem-based learning" method in university studies are analyzed. Sunt examinate, de asemenea, caracterele și tipurile competenței acestor autorități. Competența este elementul de bază al statutului juridic al autorităților administrației publice. Conținutul competenței unei autorități publice ne permite să determinăm locul și rolul acesteia în cadrul mecanismului statal.Item TIPURI DE GUVERNE CONTEMPORANE. ASPECTE DE DREPT COMPARAT(2016) Țurcan, LilianaPrezentul articol constituie un studiu dedicat diverselor tipuri de guverne existente în țările contemporane. Scopul acestui articol este de a analiza normele constituționale referitoare la formarea și încetarea activității guvernului, structura și componența acestuia în diverse state și de a descrie rolul guvernului într-o societate contemporană. Studierea comparată a instiuției guvernului ne permite să concluzionăm că nu există un model unic de organizare și funcționare a acestei autorități publice, reglementările juridice în domeniul dat fiind diferite de la un stat la altul.Item PROBLEM BASED LEARNING AT THE LAW SCHOOLS(2016) Țurcan, Liliana; Zamfir, Natalia; Vidaicu, MihaelaAcest articol își propune să examineze învățarea bazată pe probleme la facultățile de drept din Republica Moldova. Luând în considerare faptul că curricula școlilor de drept actual conțin mai multe elemente de învățare bazată pe probleme, autorii acestui articol furnizează exemple de intervenții specifice utilizate în predarea mai multor ramuri de drept. În special, autorii au descris utilizarea unor proiecte individuale de cercetare pentru dreptul administrativ, a unui proiect de grup pentru dreptul constituțional, precum și rezolvarea unei probleme practice pentru dreptul mediului. Autorii au subliniat necesitatea unei abordări bazate pe probleme pentru alte ramuri de drept, precum și, ținând cont de specificul studiilor juridice, necesitatea includerii în programa universitară a cursurilor de abilități juridice. Mai mult decât atât, autorii au venit cu o listă de recomandări pentru a facilita introducerea învățării bazate de probleme la facultățile de drept.Item REFORMELE ADMINISTRATIVE ÎN ŢĂRILE DEMOCRATICE LA SFÂRŞTUL SEC.XX-ÎNCEPUTUL SEC.XXI(2016) Țurcan, LilianaPrezentul articol constituie un studiu dedicat reformelor administrative din diverse state. Scopul articolului este de a analiza factorii de bază ce determină necesitatea efectuării acestor reforme. La fel, sunt examinate scopurile şi tipurile reformelor administrative. Este descrisă esenţa reformelor administrative funcţionale, procedurale şi structurale.Item ASPECTE DE DREPT COMPARAT PRIVIND MINISTERELE(2016) Țurcan, LilianaPrezentul articol constituie un studiu dedicat administrației ministeriale din diverse state. Scopul articolului este de a analiza normele constituționale ale statelor contemporane referitoare la administrația ministerială. Sunt analizate tendințele de dezvoltare ale sistemului ministerial, precum și factorii de bază ce determină numărul ministerelor, modul de formare, organizare și funcționare a acestora în diverse state. La fel, sunt examinate principiile de organizare a administrației ministeriale.
