    OPINIA COPILULUI ÎN CONTEXTUL PROCEDURII DE ÎNAPOIERE SAU EXERCITARE A DREPTULUI DE VIZITARE A ACESTUIA

    În cadrul procedurii de înapoiere sau exercitare a dreptului de vizitare, opinia copilului urmează a fi luată în considerare, precum se procedează și în multe alte chestiuni ce privesc drepturile și interesele acestuia. Prevederile internaționale permit instanțelor administrative și judiciare să nu dispună înapoierea copilului, în cazurile în care acesta se împotrivește. Iar dat fiind faptul că, procedura de înapoiere sau exercitarea dreptului de vizitare a fost înființată cu scopul protecției intereselor exclusiv ale copilului, de opinia acestuia urmează să se țină cont obligatoriu, în cazul în care se constată că vârsta și gradul de maturitate îi permit să perceapă și să se expună asupra situației în care se află.

    The principle of the best interest of the child aims to guarantee the supremacy of his rights, compared to the multitude of rights belonging to mature people. The child turns out to be helpless when the adults disguise their revenge on each other under pretexts of special care and affection for the child. The state is impartial and has assumed responsibility for ensuring the interests of the child by implementing appropriate mechanisms. In the procedure for returning or exercising the right of visitation, the interest of the child is examined in the light of the benefits or risks that a possible return of the child or the approval of the right of visitation could bring, for the physical and mental integrity of the child.

    The international abduction of children, having regard to its civil aspects, is a civil administrative or judicial proceeding, which deals with the illicit movement or non-return of a child, which must be carried out in violation of a right of custody assigned to a person, an institution or any other body acting either separately or jointly under the law of the State in which the child was habitually resident, immediately before his or her removal or return, and together or would have been so exercised, if such circumstances had not occurred.
