    For the realization of constitutional norms the Parliament has adopted the Law of administrative contentious jurisdiction based on setting up a national juridical control of the activity of public administration bodies. The control activity has the role of regulating the implementation of the administrative decision of the decision act proper. In the article there are also explained the administrative acts concerning the national security of Republic of Moldova.

    The research studies the correlations between the right to free circulation, the right of choosing one’s own residence and that of protection. The research investigates the problems of environmental protection that appear in the process of the implementation of the fundamental right to circulation, choosing one’s own place of residence; it informs those who are interested in solving the environmental problems as, for example, pollution, etc. that could restrict the right to free circulation and the impact of free circulation on the environment.

    This article studies every ones right to live in a healthy environment, an environment that should give him the possibility to a physical and psychic prosperous development. The study brings in evidence the role and the great importance of a healthy environment on the quality of life, physical and psychic integrity of the individual. It studies the environmental protection problems in the process of implementation of the fundamental right to life, to physical and psychic integrity; some negative aspects of man’s influence on the environment as some of the negative influences of the polluted environment on the quality of life and man’s health.

    The existence of the human rights, liberties, and obligations in the domain of the environment is mentioned from the oldest times, before the appearance of the states, and even before the appearance of the law. The studies show that the first rights, liberties, and obligations settled the relations between the human being and they referred to hunting, fishing, to the protection of fire, to defense, etc. The studies also show that namely the law appeared as a necessity to settle the relations between the human being and the environment he lives in.

    Legătura cauzală – o condiţie obligatorie pentru recunoaşterea ca parte civilă în cadrul unui proces penal

    In the judiciary practice, exercising the civil action in the framework of the penal process generates discussions concerning the interpretation by some criminal prosecution representatives in the field of the applied conditions, concerning the civil part constitution. In the present article the author analyzes a recently examined case, which puts into discussion the problem available in practice as to the constitution of the person as a civil part and its solution by the the criminal prosecution body, when the invoked prejudice is not connected with de causality of the crime.

    Metodele indirecte de estimare a obligațiilor fiscale aspecte teoretico-practice [Articol]

    Prezentul articol reprezintă o cercetare complexă asupra metodelor indirecte de estimare a veniturilor persoanelor fizice și juridice, rezidente și nerezidente, control ce se efectuează în baza informațiilor din surse indirecte și are ca scop identificarea contribuabililor care au obținut venituri și nu le-au declarat. Importanța acestor metode este incontestabilă, ele fiind aplicate în majoritatea statelor cu sisteme fiscale performante, în baza metodelor date putând fi calculate obligații fiscale care au fost tăinuite de continuabilii de rea credință. Aplicabilitatea în Republica Moldova a metodelor date a luat amploare în ultimii 5 ani, prin intermediul metodelor date fiind restabilită echitatea fiscală, limitarea evaziunii fiscale cât și creșterea veniturilor fiscale ale statului. În rezultatele aplicării metodelor indirecte, de obicei se identifică venituri nedeclarate, se percep impozite pe aceste venituri, majorări de întârziere și amenzi.

    In this article we initiate the research the bodies having the duty of Fiscal Administration and namely the State Fiscal Inspectorate - a specialized body that manages the fiscal area, the Centre for Combating Economic Crimes and Corruption – the body that has the same rights in the prosecution process as the Fiscal Inspectorate, the Customs Service – body, which collect customs taxes, and the Collection Service of taxes and fees within municipalities – the body that manages the fiscal sphere in the local area.
