    DE LA SĂRBĂTOAREA NAȘTERII DOMNULUI LA SĂRBĂTOAREA „ANUL NOU” – DECONSTRUCȚII ALE OBICEIURILOR DE IARNĂ REFLECTATE ÎN PRESA DIN RSSM

    The changes that took place after the establishment of the communist regime generated a revaluation of the values and essence of the winter holidays. Between 1940 and 1987, winter calendar customs were dominated by communist ideology and the successive liquidations of popular religious traditions. Based on the politico-cultural ideology of Moscow, the strategy ”new man trening” began with the deconstruction of the traditional system of holidays and symbols and continued with the construction of a new system, with meanings and values strongly related to the ideological constructions of the regime. The customs and traditions that are practiced during the winter holidays are presented selectively, with priority given to those that take place on New Year’s Eve. The celebration of Christmas has been replaced by New Year’s celebrations. The functional changes that took place in the structure of traditional winter customs are products built in accordance with the ideological expectations of the time, proposing a different image of the past and ancient customs. In this socio-political context, the press was used as the main tools for establishing Soviet ways of celebrating and perceiving the winter holidays.

    RECUNOAȘTEREA ȘI EXECUTAREA HOTĂRÂRILOR PENALE STRĂINE

    Frontiera unui stat și imposibilitatea extrădării persoanei care a comis o infracțiune nu trebuie să constituie impedimente pentru aplicarea răspunderii penale și, respectiv, pentru restabilirea echității. Conștientizând acest lucru, recunoașterea și executarea hotărârilor penale străine a fost reglementată ca una dintre formele de cooperare internațională în materie penală. Esența acestei forme de cooperare internațională rezidă în faptul că unei hotărâri pronunțate într-un alt stat i se dă efect pe teritoriul unui alt stat, de regulă, acolo unde se află persoana condamnată. În cadrul acestui studiu s-a pus accentul pe cadrul normativ în materie, pe practica judiciară și pe doctrina referitoare la recunoașterea și executarea hotărârilor penale străine. Sunt stabilite condițiile de formă și condițiile de fond referitoare la recunoașterea hotărârilor penale străine. De asemenea, autorii polemizează pe marginea procedurii de recunoaștere a hotărârilor penale străine. În fine, sunt formulate o serie de recomandări.
