In this article, legal and social problems concerning the relation between deviance and sanction are analyzed within the 712-XVth law. A particular attention has been given to problems regarding the offence and its social and ethical consequences. Simultaneously in the paper is analyzes the problems and constraints for the development the political system and civil society in the contemporany Republic of Moldova and the perspectives of solving these problems.

Drepturile și libertăţile omului, libera dezvoltare a personalităţii umane reprezintă valori supreme și sunt garantate de Constituţia Republicii Moldova (art.1, alin.(1). Printre drepturile fundamentale constituţionale un rol decisiv оl joacă dreptul de vot, dreptul de a alege, ca pвrghie democratică de exercitare directă a suveranităţii naţionale. Tocmai din aceste motive organizarea și desfășurarea alegerilor constituie piatra de temelie a cristalizării statului de drept și democratic оn baza principiilor separaţiei puterilor оn stat, legalităţii și legitimităţii puterii.
