Educația reprezintă un factor crucial pentru evoluția umană, care conferă toate instrumentele necesare pentru dezvoltarea persoanei în cadrul mediului cultural în care locuiește. Aceasta ia forma unui proces permanent de pregătire personală, profesională, socială și culturală, care are ca scop accesul la cunoștințe, știință, tehnică și la alte bunuri și valori culturale, iar realizarea efectivă a acesteia înnobilează persoana. Scopul acestei cercetări constă în analiza condițiilor de acces la educație preșcolară și la învățământ secundar și postsecundar, prevăzute în legislație, precum și a standardelor stabilite prin sistemul Convenției Europene a Drepturilor Omului pe palierul asigurării acestui drept.

This article examines the dynamics of social trust in the Republic of Moldova, focusing on the interaction between dispositional factors and the social environment. Survey data provided by the Institute of Public Policy reveals that trust in institutions and perceptions of the country’s development direction have undergone significant fluctuations in recent years. On one hand, trust is influenced by dispositional factors such as local culture and collective values. On the other hand, the social environment is strongly shaped by political, economic, and social conditions, making it susceptible to changes within a relatively short timeframe. The authors recommend the development of an integrated analytical model and the promotion of transparency, institutional accountability, and civic engagement to strengthen trust and social cohesion in the Republic of Moldova.

Consolidarea rezilienței sociale în Republica Moldova: abordări teoretico-metodologice

This study examines the dynamics of social resilience in Moldova amidst ongoing economic, political, and environmental challenges. Aiming to identify key factors that enhance individual and community resili-ence, the research explores how Moldovan citizens perceive and respond to socio-economic difficulties. Uti-lizing a mixed-methods approach, including focus groups and in-depth interviews, the study investigates the role of individual and community resources, educational attainment, health, civic engagement, and social net-works in fostering resilience. The findings reveal significant variations in resilience levels across different social and regional groups and highlight the crucial impact of social capital and adaptive strategies in miti-gating the effects of adversity. The research contributes to the development of policy recommendations for strengthening societal resilience and promoting sustainable and inclusive development in Moldova.
Contextul politic și social al dezvoltării antreprenoriatului social în Republica Moldova

The article provides a detailed analysis of the political and social context of social entrepreneurship development in the Republic of Moldova. The authors emphasize the importance of this type of entrepreneur-ship in achieving the Sustainable Development Goals (SDGs) through innovative approaches to social and environmental challenges. Major constraints to entrepreneurship development are highlighted, such as the undeveloped policy framework, limited access to finance and low human resource capacities. The population's positive perceptions of social enterprises are also mentioned, although knowledge about the products and services offered by them remains low. The existing legal framework, although it regulates the activity of social enterprises, is considered incomplete and inconsistent. Social entrepreneurship is seen as a solution to social and environmental problems, contributing to the creation of quality jobs and social cohesion. Although there are multiple challenges, the opportunities offered by social entrepreneurship for sustainable development and social innovation are significant. The authors suggest the need for increased support from the authorities and better public information in order to fully harness the potential of social entrepreneurship in Moldova.

In order to carry out the tasks and achieve the objectives accordance with their competences, public administration authorities use not only administrative acts, which have a unilateral character, but also contracts, which are bilateral administrative acts, in particular because they are subject to public law rules and are part of the administrative law regime. The administrative contract is a contract concluded by the public authority, by virtue of the prerogatives of public power, having as its object the administration and use of public property, the execution of works of public interest, the provision of public services, the activity of civil servants, arising from the service relationships regulated by their legal status.

The need for control is imposed by the activity of carrying out by the public administration authorities the tasks of the executive power, an activity that involves administrative legal relations in a very wide sphere. The public administration viewed as a whole, presents itself as a systematized set of bodies structured according to their material and territorial competence. Administrative control is one of the forms of control to which the activity of local public authorities is subject and which is based on the constitutional and legal norms relating to public administration. Control is called to ensure strict compliance and exact execution of laws and other normative acts, compliance with discipline by public administration authorities, civil servants, by enterprises, institutions and organizations.

The Republic of Moldova as a member of the Council of Europe proclaimed the principle of local autonomy in accordance with the European Charter of Local Self-Government, which considers local communities to be one of the main foundations of any democratic regime and the right of citizens to participate in the management of public affairs can be exercised in the most direct way at the local level and is part of the common democratic principles of all member states of the Council of Europe.In the essence, this one represents the transfer of some competences from the central level to different administrative organs and authorities, which function separately in the territorial-administrative units.

The problem of public administration finances is one of most argumentative problem in the Republic of Moldova. Considering it we must say that one of the main goals in researching this problem is to elucidate the principles that govern the finances of public administration. The doctrine and legal settlements enumerate some principles that refer to administrative autonomy, decentralization, etc., but there are no principles concerning directly the finances of local administration. That’s why the main objective of present research is to find out the principles mentioned in doctrine and legislation, to systemize them in order to make clear the system of principles that govern the local finances, taking into consideration that the viability of a local administration is determined mainly by the existence of material and financial sources.

This qualitative research explores social resilience in the Republic of Moldova, focusing on diverse regional perspectives. The study aims to investigate how individuals and communities perceive and navigate social challenges, utilizing in-depth interviews across various localities including villages, towns, and cities. Through thematic analysis, the research identifies key factors influencing social resilience, such as community cohesion, cultural identity, economic opportunities, and governance practices. Findings highlight the multifaceted nature of resilience and its crucial role in addressing socio-economic uncertainties and fostering sustainable development. The study concludes with implications for policy-making and institutional strategies to strengthen social resilience at regional and national levels, contributing to broader discussions on societal well-being and adaptive capacity.

Contraventional sanctions are a category of legal sanctions that apply in the case of committing contraventional acts. Of the various types of sanctions, an important role is played by the contraventional sanction, because it represents a measure of constraint and re-education, which is applied to the perpetrator of the wrongful act in order to correct and re-educate it, as well as in order to prevent the committing of other contraventions. Penalties are the effect of the contravention liability, which in turn is the legal consequence of committing the contravention.
