    The assistance of the central authority in implementing the provisions of the Convention on the Civil Aspects of the International Abduction of Children has a very important role in protecting the best interests of the child to live in an ordinary and favorable environment, as well as to communicate with both parents and the extended family. The central authority may be the authority of the requesting State as well as the authority of the requested State. In any situation, the central authority of the state must cooperate efficiently and in timely manner to ensure the immediate return of children moved or detained illegally and to allow the realization of the right of visit. At the same time, it is for the central authority to take the preliminary steps for the out-of-court and amicable settlement of the family dispute.

    CARACTERUL CONTENCIOS AL CAUZELOR PRIVIND RĂPIREA INTERNAŢIONALĂ DE COPII

    Prezentul articol constituie o cercetare ştiinţifică prin conţinutul căreia se examinează caracterul contencios al cauzelor privind răpirea internaţională de copii. Prezenţa litigiilor este iminentă în cauzele privind înapoierea sau exercitarea dreptului de vizitare a copilului din cauza intereselor contrare ale persoanelor în a cărui grijă se află copilul. În acest demers este evidenţiată necesitarea asigurării unui echilibru între interesele superioare ale copilului şi drepturile părinţilor săi. În baza prezentei cercetări au fost formulate concluzii şi recomandări ce pot fi utile pentru eventualele modificări legislative.

    DREPTUL TATĂLUI LA CONCEDIU PENTRU ÎNGRIJIREA COPILULUI PÂNĂ LA VÂRSTA DE 3 ANI

    Dată fiind evoluția reglementărilor existente privind concediul pentru îngrijirea copilului până la vârsta de 3 ani acordat tatălui și necesitatea unei informări corecte și complete, ne vom aprofunda tratând aspectele esențiale prin raportare la legislația în vigoare și la câteva aspecte doctrinare. În cadrul prezentului articol urmează a fi cercetate următoarele aspecte: noțiunea, durata, condițiile de acces la primirea indemnizațiilor pe parcursul concediului de creștere a copilului de către tată, garanțiile de care beneficiază tatăl aflat în concediu de creștere a copilului. Actualitatea temei cercetate se manifestă în condițiile de egalitate juridică dintre mame și tați la creșterea și educarea copiilor.

    This article reflects the application of article 13 of the Hague Convention of the Civil Aspects of International Child Abduction. The serious risk exception protects the child from domestic violence, in cases where the return to the state of habitual residence would have unbearable consequences for the physical, mental integrity or consequences that would otherwise affect the interests of the child.

    REŞEDINȚA OBIŞNUITĂ A COPILULUI PĂRINȚII CĂRUIA LOCUIESC ÎN STATE DIFERITE

    The article discusses the main aspects of the habitual residence of the child with the parents that live in different states. After a short introductory part, there are analyzed the issues relating to the definition of habitual residence, the differences between habitual residence and other legal concepts, the importance of respecting the best interests of the child in the event of the detemination of habitual residence. It take into account the provi- sions of the Hague Convention on the Civil Aspects of International Child Abduction, the Civil Code of the Republic of Moldova, the Family Code of the Republic of Moldova, law no. 112 of 09.07.2020 for the amendment of certain normative acts. In the final part are presented the conclusions that emerge from this study.
