ASPECTE DE ORDIN TEORETIC ȘI PRACTIC(CEP USM, 2024) Cuciurca, DoinaParlamentul, exercitând funcția de îmbinare a suveranității poporului cu puterea de stat, indică izvorul real al puterii într-un stat democratic. Astăzi această instituție, în pofida deținerii unor funcții de importanță majoră, precum cea reprezentativă, legislativă și de control asupra executivului, se confruntă cu numeroase provocări ce știrbesc din autoritatea sa de organ suprem reprezentativ și unica autoritate legislativă. Acest studiu scoate în evidență principalele avantaje și dezavantaje ale parlamentarismului autohton și propune soluții pentru consolidarea capacităților Parlamentului Republicii Moldova în realizarea funcțiilor sale, reformele instituționale şi constituţionale propuse având ca scop diminuarea tendinţelor de personalizare a puterii şi accentuarea tendinţelor de parlamentarizare a vieţii politice.Item ASPECTE CONCEPTUALE PRIVIND ESENȚA PARLAMENTARISMULUI CA FENOMEN POLITICO-JURIDIC(Tipografia Artpoligraf, 2019) Cuciurca, DoinaParliamentarianism as a legal category is a multidimensional and complex phenomenon. When defining parliamentarism as a subjectof research, a series of methodological issues arise. Despite the frequent use of the concept of „parliamentarism” by scholars, there are still many uncertainties and questions about its essential characteristics. Perceiving parliamentarism only as a variety of forms of government is clearly insufficient. Parliamentarism is a multi-faceted phenomenon, with a complex internal structure, encompassing interdependent elements. Parliamentarianism also defines the organization of public life, the level of assurance of the rights, obligations and freedoms of citizens, i.e. the degree of democratization of society. As a result, parliamentarianism can only be related to democratic governance, although there may be parliaments in authoritarian regimes.Item ASPECTE TEORETICO-PRACTICE PRIVIND EVOLUȚIA ŞI ESENȚA PARLAMENTARISMULUI(S.C. Drawing on functions of representation, lawmaking and control, parliaments are uniquely positioned to understand and control the impact of poverty and to serve as a bridge between government, the private sector and civil society. The role of Parliament in planning strategies to combat poverty, promoting active social participation in economic development, is highlighted. Parliamentarians can contribute to national efforts to reduce poverty by studying and highlighting the results of the fight against poverty, participating in the creation of a new initiative to eradicate it, and providing oversight during the implementation of government programs. The main goal of this research is to identify the ways of rationalization of the activities of the Parliament in the Republic of Moldova in the perspective of European integration. Without delving into the concept of rationalized parliamentarism, based on a detailed analysis of the provisions of the Constitution, laws and independent reports on Parliament’s activity, the author reveals, and characterizes the key features of rationalization of the Parliament’s activity. The study is relevant since further rationalization will help to increase the effectiveness of the work of the Parliament, as well as to improve the mechanism of interaction between the highest bodies of state power and will strengthen the democratic and legal foundations of public administration in the Republic of Moldova.Item REFLECŢII PRIVIND SUVERANITATEA POPORULUI(CEP USM, 2013-09-26) Cuciurca, DoinaItem REPERE CONCEPTUALE PRIVIND PARLAMENTARISMUL. CRITICA NATURII PARLAMENTARISMULUI(CEP USM, 2020) Cuciurca, DoinaIn this article parliamentarism is discussed in the context of criticism of its nature. The parliament represents the historical phenomenon, which rose from spirit of a discussion and publicity. Its emergence is not connected only with democracy. The parliament is a point of impact of power groups for clarification of the positions, which are not giving into decisions of the state law. Becoming the most important institute of the state, the parliament has no sufficient legitimacy yet. The public contract with the people gives the required legitimacy to parliament, by means of his communication with the natural law. The connection of democracy with parliamentarism has contradictory character. The true attributes of a discussion consign to the past, and its place is taken by promotion and accounting of interests. On the other hand, the spirit of parliamentarism will transform sense of justice and the political culture of society at the heart of which in- dissoluble communication with publicity and a discussion is found again.
