    ACTIVISM VERSUS PASIVITATE – MODELE SOCIALE DE CONFIGURARE A BUNEI GUVERNĂRI ÎNTR-UN STAT DE DREPT

    Le concept de bonne gouvernance est actuel et plein de valeur sémantique. Au fil des ans, il s’est considérablement développé en République de Moldova, qui a contribué et continue de contribuer directement à la consolidation de l’État de droit. À travers cet ar- ticle, nous avons exposé l’idée que l’activisme est le meilleur modèle social pour configurer la bonne gouvernance dans un État de droit. En même temps, nous avons évoqué l’idée que les jeunes, y compris les futurs avocats, par leur propre exemple de comportement, peuvent promouvoir les principes de bonne gouvernance au niveau local et peuvent être activement impliqués dans le processus de prise des décisions en collaboration avec les institutions politiques, locales, régionales et les décideurs nationaux.

    CARE, TOTUŞI, ESTE MIZA CĂLĂTORIEI SPRE BUNA GUVERNARE ÎN JUSTIȚIE?

    The present paper is about the stake of the journey to good governance and the role of justice, as a branch of the state power and a public service, in this process. Even if universal methodologies and strategies to ensure good governance do not exist, certain landmarks (principles) of realization and evaluation of the act of power, as well as per- formance and progress indicators can be identified. It is extremely important, in these searches, to be considered that good governance is a human right and an obligation of the state, justice being, in our opinion, the most appropriate potential ally of the society in ou- tlining a beginning of guaranteeing of human right. How? By returning of the essence of justice to its origin, by displaying independence, impartiality and integrity and by being close to the Person as a Human Being with soul and thought.

    The purpose of the present paper consists in the synthetization of the role of the judicial inspection body, as an element of judicial self-government, in ensuring the balance between transparency and confidentiality in the activity of Justice, in terms of its public presence and voice. How visible should the judicial inspection be in conditions of a transparent Justice? To the extent that people – professionals and non-professionals – know about its existence, its role and general operational aspects. How loud should the judicial inspection be? Loud enough: both for the public and for the Judiciary. Which would be the most appropriate means of public communication? It is at the discretion of judicial self-government. It is important this kind of communication to be a strategic one.

    CENTRALITATEA UTILIZATORULUI SERVICIULUI JUSTIȚIEI PRIN PRISMA COMUNICĂRII JUDICIARE

    User-based justice means free access to justice, fair trial, ethical conduct of judges, independence and impartiality of judges and courts. But user-based justice means motivated judicial decisions as well, as a form of judicial communication. Abilities of legal writing are essential for ensuring the decision-making quality and efficiency. How to write well a legal act is a question of interest for all legal professionals, who need to join efforts and thus prove mutual respect and respect for courts’ users. Good governance and good governance in justice have the human and fundamental human rights as a reference point. These values justify the need to emphasize the human face of justice and of the judge. However, the same values justify a special state and society attitude towards the human face of justice and the judge.

    Changing the mentality is not a mission of the university

    This study is carried out within the framework of the State Project (Republic of Moldova) „Modernization of governance mechanisms focused on the protection of human rights (cypher 20.80009.1606.15). The proposed theme for research is to identify the extent of the university mission and of the law faculty in the direct realization and promotion of education, research, innovation and societal integration. Does higher education have implications for mentality change? How do we react to defensive or skeptical attitudes from students regarding the university's involvement in changing mindset? What feedback can we give to skeptics, not to imagine that we might be persuasive, but at least to make them think? The research is a result of a reflection exercise in the context of conducting practical classes at the law faculty, with first-year students, Cycle I, licence (bachelor). Influenced by the social environment, affected by crises, in which even justice does not have the best image, they accept change in itself only as a theoretical formula, not as a practical one, only as a story told, not assumed. A formidable solution, excellently functional for reorienting the way of thinking of the current generation of students is hard to find, given the objective limits of communication and the formative substrate of the mentality of young people before their access to higher education. However, the university must also value ethical, attitudinal, affective, creative dimensions. And the law faculty must also emphasize the revitalization of the essence of civic courage, implicitly – to shape courageous lawyers.

    Confidentiality and transparency in the judicial inspection works. the case of the Republic of Moldova

    The general findings of the present paper refer to the fact that the overall activity of the judicial inspection body is confidential. However, there are also transparent activities, due to the necessity of alignment of the judicial inspection body to the policies of good judicial self-government, that presuppose the openness of public authorities, including the Judicial Authority, towards the society. Thus, the competencies of the judicial inspection body should be exercised in a manner that ensures the balance between confidentiality and transparency, in order to protect the independence and the reputation of judges, as well as the public interest, as an immanent element of the public confidence in the Judiciary.

    CRITERII DE EVALUARE A CALITĂȚII ȘI EFICIENȚEI ACTIVITĂȚII INSPECȚIEI JUDICIARE

    The scope of the present paper is to synthetize, based on pertinent international standards and on the legal doctrine, certain evaluation criteria of the quality and efficiency of the judicial inspection activity, in order to value judicial selfgovernance on the dimension of improving the overall activity of Justice as a public service, as a protector and guarantor of Human Rights. Judicial inspection bodies, in the conceptual approach of the investigation, are those entities – exponents of the Judiciary, but different from Councils for the Judiciary, that exercise competencies in the area of disciplinary liability of judges and in the area of verification of organizational activity of courts. The research is focused on an analysis of three evaluation criteria – professional, operational and institutional (without pretending them to be exhaustive), each of them being represented by certain indicators. Qualitative and efficient activity of the judicial inspection body have an essential contribution in the process of reformation and of consolidation of Justice in the conditions of contemporary society.

    DEBIROCRATIZAREA SEGMENTULUI COMUNICAŢIONAL ÎN JUSTIŢIE PRIN ÎNCURAJAREA SPIRITULUI ASOCIATIV AL JUDECĂTORILOR

    Starea justiţiei naţionale, prin prisma credibilităţii sale publice, nu se încadrează într-o măsură suficientă în dimensiunea valorică a unui stat de drept. Şi dincolo de multiple dificultăţi cu care se confruntă judecătorii individuali şi justiţia, ca sistem, un factor important în configurarea imaginii magistraturii îl reprezintă politică sa comunicaţională. De regulă, aceasta ţine de competenţa Consiliului Justiţiei sau a instanţelor de judecată, prin intermediul unui ofiţer de presă sau al unui purtător de cuvânt. Realitatea naţională denotă faptul că o asemenea formă de comunicare este deficitară, având la bază motive de natură obiectivă şi subiectivă. În atare condiţii, considerăm necesar a găsi soluţii pentru a debirocratiza segmentul comunicaţional în justiţie prin edificarea unui alt fel de sector asociativ – a unei organizaţii non-profit în interiorul magistraturii, care să confere acesteia voce, susţinere şi credibilitate. Studiul este realizat în baza Proiectului „Modernizarea mecanismelor de guvernare axate pe protecţia drepturilor omului” (20.80009.1606.15) în cadrul Laboratorului de Cercetare Ştiinţifică „Drept Public Comparat şi e-Guvernare”, Facultatea de Drept, USM.

    At present, national authorities assume Declarations of good governance and promote a greater involvement in the process of satisfying the public interest through getting closer to social needs and aspirations. However, this has not influenced in a positive manner the level and the degree of happiness of our people, the Republic of Moldova ranking 64th out 146 countries according to the happiness index. Maybe a solution should be found in reshaping on ethical principles the theory of law in a technologized world, in promo- ting the culture of happiness awareness and the ethics of forming this culture. The role of freedom and education in this journey is crucial.

    The present communication is based on the appreciation of the quality and efficiency of national legal norms, according to whom the person who intends to candidate for the position of inspector in the Judicial Inspection within the Superior Council of Magistracy must have not exercised the function of judge during the last 3 years. Such a restriction contravenes the European standards on the composition of bodies with particular competencies in disciplinary investigations against judges and undermines the essence of judicial self-governance.

    Global legal skills as a universal language of lawyers

    The profession of the lawyer seems to be national limited, due to the fact that future lawyers are trained through acquisition of knowledge on national legislation understanding and interpretation. However, empirical findings prove that lawyers need to be internationally adapted, legal concepts and standards, and value constants being the foundations of solid legal training. Thus, the purpose of the paper is to shape pillars and directions for reviewing current methodologies of teaching-learning-evaluating process in law schools, so as to enhance global legal skills, as a universal language for today’s lawyers. Globally adapted and resilient lawyers are able to contribute, both professionally and empathetically, to ensuring well-being and security of individuals

    Judges against judges

    The discipline of judges is an essential pillar of the judicial career. The proper management of this field is imperative, from the perspective of the need to ensure the balance between judicial independence and judicial responsibility, but also from the perspective of the impact of a disciplinary procedure on the image of the concerned judges and on the judiciary. In this context, the activity of the specialized bodies subordinated to the Superior Council of Magistracy with competencies regarding judicial discipline (the Disciplinary Board and the Judicial Inspection) is of increased doctrinal and professional interest. An overview of the current situation on this dimension is reflected in the Decisions of the Disciplinary Board and in the Annual Activity Reports of the concerned entities. The paper includes an analysis focused on a new trend found by the Judicial Inspection in 2022, namely on the fact of the submission of notifications regarding possible disciplinary violations committed by judges - also by fellow judges. What would be the causes that generated such a trend, how does this trend reflect the state of affairs in the judiciary, what would be the role of judicial self-government in ensuring the responsibility of individual judges and what would be the value of professional communication within the judicial system - these are some aspects researched in the paper, from the perspective of governance modernization mechanisms, focused on the protection of human rights.

    LA PROTECTION JURIDIQUE DES JUGES POURSUIVIS PENALEMENT PAR DES MECANISMES D’AUTOGOUVERNEMENT JUDICIAIRE

    Prezenta lucrare cuprinde analiza cadrului normativjuridic național privind instituția răspunderii penale a judecătorilor, cu accent pe etapa prealabilă pornirii urmăririi penale și etapa incipientă a urmăririi penale. Este sintetizată valoarea autoadministrării judecătorești – a Consiliului Superior al Magistraturii și a Inspecției Judiciare - în procedura examinării demersurilor Procurorului General privind pornirea urmăririi penale sau efectuarea unor acțiuni specifice de urmărire penală (reținere, aducere silită, percheziție, arestare) în privința judecătorilor. Cercetarea este axată pe identificarea mecanismelor de care dispun organele de autoadministrare judecătorească în vederea protejării juridice a judecătorilor urmăriți penal, fiind argumentată necesitatea recunoașterii unor garanții suplimentare acestei categorii de profesioniști, datorită statutului lor specific, comparativ cu cel al altor subiecți de drept.

    Legal writing: takeways from the study visit to the William and Mary Law School

    The paper presents a brief evaluation of the takeaways emerging from the academic life at William and Mary Law School, Williamsburg, Virginia, USA, focused primarily on the Legal writing course and on the supporting institutional mechanisms for improving the quality of higher education, and for enriching the professional background of future lawyers, under conditions of current global trends. The main findings result from on-site observing of the teaching-learning evaluating process, through interactive and collaborative activities. As a general conclusion the quality of legal higher education can be improved only through multidimensional and intersectoral synergies, including academia, civil society, public authorities, employers. Investments in human resources and in infrastructure, open mindedness in the teaching-learning-evaluating process in legal schools are part of the knowledge management and they really count.

    MODUL DE APRECIERE A CATEGORIILOR DE ADRESĂRI EXAMINATE DE INSPECȚIA JUDICIARĂ

    Conduita profesională a judecătorilor prezintă interes sporit pentru societate, prin intermediul lor fiind exercitat nemijlocit actul de justiţie. Din aceste considerente, monitorizarea calitativă a activităţii acestei categorii de profesionişti este o necesitate mereu actuală într-o societate democratică. Prezenta lucrare face referinţă la mecanismele de control din partea Autorităţii Judecătoreşti a domeniilor privind etica, deontologia profesională şi disciplina judecătorilor. Este efectuat un studiu asupra procedurilor de examinare de către Inspecţia Judiciară a petiţiilor şi sesizărilor adresate Consiliului Superior al Magistraturii, cu relevarea similitudinilor, dar şi a particularităţilor fiecăreia dintre proceduri. Este accentuat rolul Inspecţiei Judiciare, ca parte inerentă a Autorităţii Judecătoreşti, în responsabilizarea magistraţilor, prin mecanisme strict reglementate de lege şi cu respectarea prioritară a independenţei judecătorilor, în parte, şi a Justiţiei, în general.

    Nicolae Steinhardt and Leon Duguit face to face after (almost) a century

    This alignment of two names might seem at least strange or exaggerated: Leon Duguit and Nicolae Steinhardt. At the time of defending the thesis in 1936 by Nicolae Steinhardt, a young man of 24, Leon Duguit was no longer alive, but he had left an impressive scientific work. That is, it would be said that there is no place for comparison, the equality of arms being utopian. And yet the comparison is opportune, because it is about ideas to which history may or may not have given its answer.
