The right to liberty is one of the most fundamental human rights. Sexual autonomy, that means someone’s prerogative to determine when, with whom, and under what circumstances they engage in sexual activity, is one of the basic components of the general right to liberty. The problem of the victim’s consent in sexual offenses is extremely actual. The novelty of the investigated topic and the obtained results lies in the innovative character of the approach of the victim’s consent within the crimes against the sexual inviolability and sexual freedom of the person. By explaining and interpreting the notions of criminal law, the study has the aim to try to contribute to the standardization of judicial practice and to be a useful working tool for practicians, and the conclusions and proposals can be taken into account to improve judicial practice in this field.
CYBERBULLYING: PROVOCARE SAU REALITATE?

Cyberbullying or cyberharassment is a form of bullying or harassment using electronic means. Cyberbullying and cyberharassment are also known as online bullying. It has become increasingly common, especially among teenagers, as the digital sphere has expanded, and technology has advanced. The lack of specific regulations in the national criminal and contravention legislation makes it difficult to qualify cyberbullying and makes it almost impossible to hold people accountable for such acts. Following the analysis, some proposals of lege ferenda will be outlined, in order to adapt the national criminal / contravention legislation to the current conditions.
DETERMINAREA SAU ÎNLESNIREA SINUCIDERII ÎN LEGISLAȚIA PENALĂ A REPUBLICII MOLDOVA ȘI ÎN CEA A STATELOR MEMBRE ALE UNIUNII EUROPENE: ANALIZĂ DE DREPT COMPARAT

În contextul perfecționării continue a art. 150 din Codul Penal al Republicii Moldova, crește semnificația recepționării experienței legislative pozitive a statelor membre ale Uniunii Europene în materie de reglementare a răspunderii penale pentru determinarea sau înlesnirea sinuciderii. Scopul studiului de față este de a analiza art. 150 din Codul Penal al Republicii Moldova și normele corespondente din legile penale ale statelor membre ale Uniunii Europene, pentru a stabili asemănările și deosebirile dintre aceste norme și pentru a formula recomandările de perfecționare a art. 150 din Codul Penal al Republicii Moldova. Baza metodologică a prezentului studiu îl constituie metoda de drept comparat și metoda de analiză sistemică. În rezultatul studiului efectuat, au fost conturate reperele de armonizare în perspectivă a prevederilor Capitolului II din partea specială a Codului Penal al Republicii Moldova cu prevederile corespondente din legile penale ale statelor membre ale Uniunii Europene.

Domestic violence has become one of the most prevalent phenomena. People are becoming more vulnerable even in their family environment. Often, victims of domestic violence, because of shame or fear, do not report cases of domestic violence committed against them, and to end the suffering they resort to acts of suicide. In this article we will analyze the essential aspects for the qualification of the acts of determination to suicide or attempted suicide in the context of acts of domestic violence.

The Internet is supposed to be one of the most discussed topic in recent years, especially, the interest is concentrated on the dark side of the Internet (DarkWeb). However, from a legal point of view, we cannot identify sufficient studies and research that would clarify the legal status of this issue, but also the legal limits of the possible activities in the dark web. We can say that DarkWeb is a space for cybercriminals and black markets, arguing that the emphasis is on its anonymity. This is also a reason why it has remained undirected by the state. Governments must emphasize the institutionalization of the possibility of the anonymous use of the Internet, ensuring the rights and freedoms of all web users regardless of the virtual area where it is located, SurfaceWeb, DarkWeb.
OBIECTUL JURIDIC SPECIAL AL INFRACȚIUNII PREVĂZUTE LA ART. 150 DIN CODUL PENAL

The person's life has a social nature, and his penal protection is determined bythe relationships that prevail in society. The person's life, not the person's right to life,is what is defended, among others, against the crime of determining or facilitatingsuicide (art. 150 of the Criminal Code of the Republic of Moldova). The life of theperson is an integrated social process that unfolds over time, interconnected with the environment, which begins with the birth of the individual and ends with his biological death. A person's right to life is a recognized legal prerogative, guaranteed at the constitutional level, which allows a person to enjoy life, from birth to death,without being arbitrarily deprived of it. This right also implies the possibility of the person to live a decent life, safe and be respected by others. Not the right to die, but the right to die with dignity is part of the content of the right to life. Social relations regarding the person's life form the juridical object of the sub-group of the crime provided by the art. 150 of the Criminal Code of the Republic of Moldova. The special juridical object of the crime, provided by the art. 150 of the Criminal Code of the Republic of Moldova, is constituted by the social relations regarding the person's life,which are protected against determining or facilitating suicide.
PROTECȚIA INTERESULUI SUPERIOR AL COPILULUI ÎN MEDIUL ONLINE

This article will analyze the main risks related to the child's safety in the digital environment. There will be outlined some proposals that will help to combat these risks and to consolidate a child-friendly digital environment.
