CELE MAI ÎNCĂLCATE DREPTURI ALE COPILULUI ÎN REGIUNEA TRANSNISTREANĂ. PROVOCĂRI ȘI SOLUȚII

When we approach the human rights situation in the Transnistrian region of the Republic of Moldova, we must always take into account the status of this territory. The territory to the left of the Dniester is isolated, closed and not controlled by the constitutional authorities of the Republic of Moldova. Moreover, according to the Constitutional Court of the Republic of Moldova and more recently, the Parliamentary Assembly of the Council of Europe, this territory is occupied by the Russian Federation, due to its military presence. However, because the Transnistrian region legally belongs to the state of the Republic of Moldova, it has positive obligations to promote and protect fundamental rights and freedoms in this territory. Thus, the solutions and recommendations at the end of this article are largely addressed to the authorities of the Republic of Moldova.
Importanţa cauzei Ilaşcu şi alţii în contextul eforturilor autorităţilor Republicii Moldova de asigurare a respectării drepturilor omului în regiunea transnistreană

Fiind sesizată în premieră să examineze situația drepturilor omului din regiunea transnistreană, Curtea Europeană a Drepturilor Omului (CtEDO) a decis că în pofida lipsei controlului efectiv în regiunea transnistreană, autoritățile constituționale ale Republicii Moldova au obligații pozitive și trebuie să depună eforturi pentru a asigura respectarea drepturilor omului în acest teritoriu. La o distanță de 20 de ani de la pronunțarea hotărârii în cauza Ilașcu și alții, constatările CtEDO rămân la fel de valoroase și pertinente. Mai cu seamă, pentru că autoritățile constituționale nu le respectă în mod integral și nu le oferă atenția necesară pentru a le da efect și, astfel, a produce o schimbare semnificativă în calitatea protecției drepturilor omului și, mai larg, a principiului statului de drept în regiunea transnistreană.

Because the Transnistrian region is not temporarily controlled by the constitutio- nal authorities of the Republic of Moldova, the promotion and protection of human ri- ghts in this region remains an ongoing challenge. Thus, international mechanisms for the protection of human rights are important. The mechanisms of the UN, together with those within the Council of Europe, are the most relevant and effective mechanisms for the protection of human rights, including for territories not temporarily controlled by the constitutional authorities.
