    В статье рассматриваются перспективы расширения Европейского Союза в направлении Западных Балкан. И несмотря на то, что пока ни один кандидат западных Балкан не готов к вступлению в ЕС, страны кандидаты ведут переговоры, в которых акцентируют внимание на вопросах верховенства права, правосудия и соблюдения основополагающих прав. Также в работе рассматриваются действия Европейского Союза, поддерживающего инициативы Балканских государств в различных областях, основываясь на "Критериях Копенгагена", которые являются основой Стратегии расширения на Западные Балканы.

    THE IDENTITY APPROACH TO SOCIAL COHESION AS AN ESSENTIAL COMPONENT OF NATIONAL INTEREST

    National interest is the direction of domestic and foreign policies of a state. It is measured by the level of security and well-being of the state and its citizens, and in democratic states, it is indicated by the requirements of all stakeholders of national interest. The formation of a national interest follows the following scheme: Interest > Necessity > Awareness > Action. At present, the Republic of Moldova is between the necessity and awareness of national interest, as society is highly divided and there is no primary national interest with a general consensus. Even statehood or sovereignty are not a national interest with absolute support. This paper demonstrates the dynamics of national interest and the necessity of addressing the identity issue for social cohesion and achieving broad consensus regarding the national interest of the Republic of Moldova

    DE LA CENZURA GUVERNAMENTALĂ LA CENZURA PRIVATĂ: CE ÎNSEAMNĂ ASTA PENTRU DEMOCRAȚIE?

    In the informational era, where digitalization is extremely important, censorship can take on another, unforeseen and unexpected form. Although in a constitutional and legal framework of a state governed by the rule of law, freedom of expression is guaranteed, censorship remains an integral function in any state implementing a system of prohibitions, restrictions, and propaganda mechanisms. There is a clear distinction between censorship in democratic states and totalitarian ones. The modern dilemma is linked to how new technologies can facilitate the emergence of censorship and negatively impact the democratic principles of Western civilization.

    CONSTITUTIONAL LAW-MAKING IN WARTIME: INSIGHTS AND FUNCTIONAL ANALYSIS

    The paper discusses general issues related to the respect of constitutional principles as essential sources of constitutional-law making in wartime in Ukraine. The research contributes to the development of the study of the issue of legislation by applying the existing concept of constitutional law-making. Enshrined in the Preamble of the Constitution of Ukraine, the state strategic course for Ukraine’s full membership in the European Union and the NATO provides for the strengthening of the rule of law through the implementation of this course by public authorities, courts and judges, the legitimization of their activities in accordance with the features of European constitutionalism, and the development of civil society under martial law. The study analyses the ensuring of the implementation of constitutional and legal norms both through state coercion and through legal awareness of the people of Ukraine. The relationship between the implemented legislation and the existing legal system under wartime in Ukraine. This study contributes to extant research by adopting the existing concepts of law and law-enforcement.

    This article examines the challenges of good governance in the context of its inclusion in the 2030 Sustainable Development Agenda through SDG 16. In essence, good governance is related to the political and institutional processes and results necessary to achieve development goals. The true test of good governance is the extent to which it fulfills its human rights promises: civil, cultural, economic, political and social rights. The key question is whether governing institutions effectively guarantee the right to health, adequate housing, sufficient food, quality education, fair justice and personal security.

    COOPERAREA ÎN ATINGEREA OBIECTIVELOR DIN PARTENERIATULUI ESTIC ÎNCETINITĂ DE CORUPȚIA DIN EST

    The Eastern Partnership from the beginning was a progressive tool and optimized application of the European Neighborhood Policy targeting Eastern Europe and Caucasus. It helped the partner countries to enter new markets proportionally to their interests and ensured the beneficiaries with aid in order to enhance democracy and eradicate corruption. More than 25 years of independence and corruption were sufficient to result in economic and social inequalities despite the last 2-3 generations growing up in communism during half of the century. The first 10-15 years of independence and privatizations were the most reorganizing ones and the most favorable for flourish corruption and sufficient to bring the populations at the edge of poverty. Today, in 2023, is the last call to bring back to the table the discussion about Eastern Partnership because of the fast changes in the region and the turbulent events of 2022. The Eastern Partnership was a necessary next step in developing and consolidating the relations of the European Union with eastern neighbors. Taking the responsibility of promoting democracy and the rule of law in a region with deep-rooted corruption was a sign of trust and commitment, especially when we have as partners some CIS member states. The goals of having a closer political association and economic integration were a vital measure for the penetration of new markets at new dimensions and strategic diversification or reorientation. It is also a big advantage for the EU by having this type of partners and their potential of production, exports, and their costs. But the debate between union and decentralization (bio trilateral agreements) seems to be also sensible for this partnership. From 2022 we have an “Associated Trio” composed of R. Moldova, Ukraine, and Georgia, of which just R. Moldova and Ukraine received the status of EU candidates. Also, we had an escalation of the conflict between Armenia and Azerbaijan, and the participation of Belarus in EaP is still suspended, even more, it was subjected to new sanctions packages. The Russian aggression in Ukraine caused a new sort of crisis and instability in the region, and the peoples started to prioritize the politicians with visions and agendas oriented to ensure the peace in a way which will build a stable economy and good governance. But all these ideas circulate in a mixture of misinformation that can present a destabilization at any moment, especially in the case of states with internal conflicts.

    THE DEMOCRATIC POTENTIAL OF THE TRADE UNIONS IN THE CONTEXT OF GLOBALIZATION (THE CASE OF THE REPUBLIC OF MOLDOVA)

    The goal of this research is to emphasize the role of which trade unions are played in implementation of democratic values. Their democratic potential is due in the inevitably role of trade union as economic and political actors, the relationship between these two roles is complex and contradictory, and the priority assigned to each varies depending on the country and the historical period in which it exists. As a result of the research, essential methodological criteria were identified, which allow to identify and analyze the particularities of the democratic potential of trade unions. An important role in this aspect is the multidisciplinary nature of research. In the research of the topic were used, first of all, the general scientific methods that facilitated the analysis and synthesis of the opinions of different scientists regarding the concept of trade union movement, democracy, democratic potential, democratic values.

    THE EUROPEAN UNION’S MULTILATERAL DIPLOMACY: PARTNERSHIPS FOR PROMOTING DEMOCRACY

    The article addresses the European Union’s efforts to forge a new generation of partnerships aimed at strengthening international cooperation, collaborating in and with multilateral and regional organizations, as well as other stakeholders who share democratic values. In this context, it offers an overview of a broad, diverse, and important field of modern diplomatic practice, elucidating the concepts of ,,multilateral diplomacy” and ,,multilateralism”. Moreover, drawing upon the International Relations theories, realism and liberalism perspectives, our research objective is to outline the EU’s commitment to ally and support partners in more effectively engaging with the multilateral system. As democratic principles and respect for human rights are the core elements of the EU’s identity, and deeply rooted in its foreign policy, the Union moved forward on important internal and external initiatives. This involves ensuring a systematic monitoring and pursuit of bilateral commitments with partner countries to advance the multilateral agenda and promote the safeguarding of democracy and human rights at global scale.

    PREMISELE CONSTITUIRII SOCIETĂŢII CIVILE ÎN REPUBLICA MOLDOVA

    În perioada regimului totalitar-comunist din URSS statul a încălcat suveranitatea poporului, iar timpul ce a urmat după prăbuşirea regimului comunist a fost marcat de schimbări esenţiale în statutul individului și al societăţii moldovenești în general. În același timp, a fost necesară crearea unor structuri neformale, autonome și independente care să apere drept urile cetățenilor și să le ofere mai multe libertăți de luare a deciziilor în treburile publice locale. În acest context, constituirea societăţii civile a fost posibilă nu doar prin unirea eforturilor tuturor actorilor nestatali, dar și prin creşterea potenţialului cetăţenilor în comunitate. Problema societăţii civile a început să fie discutată activ în țara noastră, mai ales odată cu recunoaşterea Republicii Moldova în calitate de subiect de drept internaţional. Iar premisele constituirii societăţii civile au fost strâns corelate de situaţia social-politică, dezvoltarea economică, crearea cadrului legislativ şi de percepţia cetăţeanului privind democratizarea ţării. Toate aceste aspecte vor fi examinate în acest articol.
