    Impactul războiului ruso-ucrainean asupra migrației ilegale ca formă a crimei organizate. Cazul Republicii Moldova

    Războiul din Ucraina reprezintă o arenă nu doar a confruntărilor dintre state, ci unul din imboldurile primordiale ale dezvoltării rețelelor criminale, implicate în trafic de droguri, arme, dar și a traficului de ființe umane. Agresiunea nejustificată a Federației Ruse în Ucraina din 2022 a marcat creșterea numărului de rețele a grupărilor implicate în organizarea traficului de persoane, în special bărbați apți de luptă din Ucraina pe teritoriul Republicii Moldova. Rețețele criminale implicate în traversarea ilegală a frontierei Republicii Moldova activează în strânsă colaborare cu cele din Ucraina, dar și România. În ultimul timp, grupările criminale implicate în traficul de persoane își consolidează tot mai mult poziția în Republica Moldova, înclusiv își fortifică activitatea prin cooperarea cu rețelele criminale din statele vecine -Ucraina și România. Prezentul articol are drept obiectiv reliefarea principalelor aspecte cu referire la impactul războiului din Ucraina asupra dezvoltării rețelelor de crimă organizată pe teritoriul Republicii Moldova, în special a rețelelor criminale implicate în traficul de persoane.

    Impactul războiului din Ucraina asupra traficului ilicit de droguri

    Declanșarea războiului de către Federația Rusă împotriva Ucrainei la data de 24 februarie 2022 tinde să devină cel mai important conflict militar de la finalul celui de al Doilea Război Mondial. Orice război, în special de această intensitate, la care asistăm în Ucraina, este de regulă un element de schimbare politico-militară și economico-socială, care condiționează schimbări și pe dimensiunea securității. Ținând cont de magnitudinea subiectului, nu pretindem să acoperim multitudinea aspectelor implicate, dar vom puncta cele mai importante momente cu referire la impactul războiului din Ucraina asupra traficului ilicit de droguri. Prezentul articol are drept obiectiv reliefarea principalelor aspecte ale traficului ilicit de droguri condițonat de emergența războiului din Ucraina. Deși în contextul războiului din Ucraina unele rute privind traficul ilegal de droguri au fost inchise datorită creșterii controlului la frontiera estică a Uniunii Europene, astăzi suntem prezenți la modificarea, schimbarea noilor rute și găsirea a noi alternative privind traficul ilicit de droguri, inclusiv în contextul războiului din Ucraina.

    SECURITATE REGIONALĂ ACTUALĂ ȘI PERSPECTIVELE DE VIITOR PRIVIND ARHITECTURA DE SECURITATE EUROPEANĂ

    Europe is currently undergoing a significant change in the realm of security, with a focus on regional security due to the lack of global security mechanisms. European agreements with Russia for maintaining peace and security on the continent are no longer functional, and Russian aggression towards Ukraine has forced European states to come together in various initiatives to strengthen their regional defense against potential Russian aggression. As a result, agreements in which Russia participated are no longer valid, and the new security architecture is being built to defend Europe against Russian revanchism. The current situation has highlighted the importance of regional security for Europe, and countries are increasingly cooperating to establish a stronger defense against potential threats. This new architecture of security includes the development of military capabilities, the strengthening of existing defense structures, and the establishment of new defense partnerships. The ongoing conflict in Ukraine serves as a reminder to European states of the potential threats they face and the need for a coordinated and effective response.

    CONSTITUTIONAL LAW-MAKING IN WARTIME: INSIGHTS AND FUNCTIONAL ANALYSIS

    The paper discusses general issues related to the respect of constitutional principles as essential sources of constitutional-law making in wartime in Ukraine. The research contributes to the development of the study of the issue of legislation by applying the existing concept of constitutional law-making. Enshrined in the Preamble of the Constitution of Ukraine, the state strategic course for Ukraine’s full membership in the European Union and the NATO provides for the strengthening of the rule of law through the implementation of this course by public authorities, courts and judges, the legitimization of their activities in accordance with the features of European constitutionalism, and the development of civil society under martial law. The study analyses the ensuring of the implementation of constitutional and legal norms both through state coercion and through legal awareness of the people of Ukraine. The relationship between the implemented legislation and the existing legal system under wartime in Ukraine. This study contributes to extant research by adopting the existing concepts of law and law-enforcement.

    CONSOLIDATIONS OF UKRAINIAN SOCIETY AND CHALLENGES OF PUBLIC ADMINISTRATION IN THE WAR CONDITIONS

    The article, based on extensive empirical material and thorough sociological research, analyzes the consolidation of Ukrainian society and challenges to public administration in the conditions of a full-scale war. The factors of the consolidation of society are determined. Emphasis is placed on the stability of Ukrainians, the presence of a political leader, and the functioning of authorities in wartime conditions.

    COOPERAREA ÎN ATINGEREA OBIECTIVELOR DIN PARTENERIATULUI ESTIC ÎNCETINITĂ DE CORUPȚIA DIN EST

    The Eastern Partnership from the beginning was a progressive tool and optimized application of the European Neighborhood Policy targeting Eastern Europe and Caucasus. It helped the partner countries to enter new markets proportionally to their interests and ensured the beneficiaries with aid in order to enhance democracy and eradicate corruption. More than 25 years of independence and corruption were sufficient to result in economic and social inequalities despite the last 2-3 generations growing up in communism during half of the century. The first 10-15 years of independence and privatizations were the most reorganizing ones and the most favorable for flourish corruption and sufficient to bring the populations at the edge of poverty. Today, in 2023, is the last call to bring back to the table the discussion about Eastern Partnership because of the fast changes in the region and the turbulent events of 2022. The Eastern Partnership was a necessary next step in developing and consolidating the relations of the European Union with eastern neighbors. Taking the responsibility of promoting democracy and the rule of law in a region with deep-rooted corruption was a sign of trust and commitment, especially when we have as partners some CIS member states. The goals of having a closer political association and economic integration were a vital measure for the penetration of new markets at new dimensions and strategic diversification or reorientation. It is also a big advantage for the EU by having this type of partners and their potential of production, exports, and their costs. But the debate between union and decentralization (bio trilateral agreements) seems to be also sensible for this partnership. From 2022 we have an “Associated Trio” composed of R. Moldova, Ukraine, and Georgia, of which just R. Moldova and Ukraine received the status of EU candidates. Also, we had an escalation of the conflict between Armenia and Azerbaijan, and the participation of Belarus in EaP is still suspended, even more, it was subjected to new sanctions packages. The Russian aggression in Ukraine caused a new sort of crisis and instability in the region, and the peoples started to prioritize the politicians with visions and agendas oriented to ensure the peace in a way which will build a stable economy and good governance. But all these ideas circulate in a mixture of misinformation that can present a destabilization at any moment, especially in the case of states with internal conflicts.

    REPERCURSIUNILE RAZBOIULUI RUSO-UCRAINEAN ÎN PERIOADA 2022-2023. CAZUL UCRAINEI

    Invazia Ucrainei de către Federația Rusă tinde să devină unul dintre cele mai importante războaie de la finalul celui de-al Doilea Război Mondial. Războiul ruso-ucrainean nu este doar un război regional, este războiul care marchează ruptura în relațiile dintre Rusia și Occident, este războiul care va avea repercusiuni profunde atât pentru Europa, cât și pentru întreaga lume. Agresiunea militară a Federației Ruse împotriva Ucrainei a readus în centrul atenției comunității internaționale acțiunile Moscovei. Repercusiunile războiului din Ucraina, vor rămâne a fi subiectul de discuție pentru mulți ani înainte în discursurile liderilor occidentali, dar va deveni și arie a cercetărilor științifice. Invazia Ucrainei de către Federația Rusă a condiționat nu doar metamorfoze în sistemul relațiilor internaționale, dar a condiționat și pierderi economice întregii lumi, în special Ucrainei, care a devenit epicentrul conflictului. Prezentul articol are drept obiectiv reliefarea repercusiunilor invaziei nejustificate a Federației Ruse asupra Ucrainei pe toate dimensiunile: economie, infrastructură, transport, sănătate, învîțământ etc.

    SECURITATEA ENERGETICĂ A REPUBLICII MOLDOVA ÎN CONTEXTUL RĂZBOIULUI RUSO-UCRAINEAN

    The energy crisis, the war in Ukraine and the rise of gas prices have conditioned the initiation of political, economic and social disputes over the supply of energy resources to the Republic of Moldova. In the situation occurred, the Government of the Republic of Moldova has declared a state of emergency. Thus, initiating stringent measures for the supply of alternative natural gas resources from sources other than the Russian Federation. This would also reduce Gazprom's dependence on electricity in relation to the Cuciurgan Thermal Power Plant (a branch of the Russian Federation), which is largely supplied with natural gas by Gazprom.

    The crisis in Ukraine in early 2014 marked a turning point in the history of international relations. A number of specialists in the field of political science have sought to explain the reasons for the occurrence of such events in the 21st century and what implications they may have for the global security system, but especially for the regional one. This article analyzes the impact of the Russian Ukrainian crisis on the security of the Republic of Moldova.

    MIGRAȚIA ILEGALĂ - FACTOR DE AMENINȚARE A SECURITĂȚII REPUBLICII MOLDOVA

    The migration waves are the cause of many challenges and risks toward the states security including the Republic of Moldova security. The illegal migration often resulted in the human being traffic, army and drugs traffic. The internal and external migration provoked the specific phenomenon for the Republic of Moldova in the last years and this fact result ed in the demographic, social, cultural and economic consequences. The migration process analyzed in the illegal light can be characterized through many factors such as: illegal crossing of the borders through different waves and methods, illegal staying in the country, illegal working abroad... This article analyzes the illegal migration as the main threat to the Republic of Moldova security. At the same time the author of this article points the importance of the main factors that are contributed to the illegal migration.
