    FUNCTIONAL DIRECTION OF ANTI- CORRUPTION POLICY TOOLS IN THE SYSTEM OF THE NATIONAL ECONOMY DETINIZATION

    This paper investigates the modern vectors to the formation of the effective anti- corruption policy as the component of a legitimacy of the economic security system in Ukraine. The functional aspect is investigated in the work and the system of indicators of anti-corruption policy is resulted. The article presents practical recommendations for improving functional direction of anti-corruption policy tools in the system of the national economy detinization; the using of state regulatory imperatives to combat systemic corruption in the national economy. The authors considered and substantiated the implementation of the experience of foreign countries in the area against corruption in national legislation, the barometer of global corruption in the coordinates of the economic development of Ukraine. The practical part of the work is represented by an economic and statistical analysis of the results of NABU activities in a dynamic sequence for 2021-2022.

    MĂSURI ANTICORUPȚIE ÎN DOMENIUL ACHIZIȚIILOR PUBLICE

    In recent years, there has been a significant increase in concern about corruption in the public domain, as it can lead to unnecessary expenditure and affect the process of effective governance. In the Republic of Moldova, public procurement remains an area vulnerable to irregularities, fraud and corruption. For this reason, it is necessary to apply anti-corruption measures in the field of public procurement. These measures are aimed at preventing and combating corruption at all stages of the public procurement process, starting with the identification of the needs of public authorities, continuing with the selection of suppliers and concluding contracts, and ending with the monitoring and reporting of obtained results.

    COOPERAREA ÎN ATINGEREA OBIECTIVELOR DIN PARTENERIATULUI ESTIC ÎNCETINITĂ DE CORUPȚIA DIN EST

    The Eastern Partnership from the beginning was a progressive tool and optimized application of the European Neighborhood Policy targeting Eastern Europe and Caucasus. It helped the partner countries to enter new markets proportionally to their interests and ensured the beneficiaries with aid in order to enhance democracy and eradicate corruption. More than 25 years of independence and corruption were sufficient to result in economic and social inequalities despite the last 2-3 generations growing up in communism during half of the century. The first 10-15 years of independence and privatizations were the most reorganizing ones and the most favorable for flourish corruption and sufficient to bring the populations at the edge of poverty. Today, in 2023, is the last call to bring back to the table the discussion about Eastern Partnership because of the fast changes in the region and the turbulent events of 2022. The Eastern Partnership was a necessary next step in developing and consolidating the relations of the European Union with eastern neighbors. Taking the responsibility of promoting democracy and the rule of law in a region with deep-rooted corruption was a sign of trust and commitment, especially when we have as partners some CIS member states. The goals of having a closer political association and economic integration were a vital measure for the penetration of new markets at new dimensions and strategic diversification or reorientation. It is also a big advantage for the EU by having this type of partners and their potential of production, exports, and their costs. But the debate between union and decentralization (bio trilateral agreements) seems to be also sensible for this partnership. From 2022 we have an “Associated Trio” composed of R. Moldova, Ukraine, and Georgia, of which just R. Moldova and Ukraine received the status of EU candidates. Also, we had an escalation of the conflict between Armenia and Azerbaijan, and the participation of Belarus in EaP is still suspended, even more, it was subjected to new sanctions packages. The Russian aggression in Ukraine caused a new sort of crisis and instability in the region, and the peoples started to prioritize the politicians with visions and agendas oriented to ensure the peace in a way which will build a stable economy and good governance. But all these ideas circulate in a mixture of misinformation that can present a destabilization at any moment, especially in the case of states with internal conflicts.

    ВОСТОЧНАЯ ПОЛИТИКА СОСЕДСТВА ЕС В ГРУЗИИ

    Acest articol se concentrează pe analiza politicii est-europene a vecinătății Uniunii Europene în Georgia. Sunt descrise mecanismele și instrumentele principale utilizate de UE pentru atingerea obiectivelor sale în relația cu Georgia, inclusiv programele de asistență financiară, asistența tehnică și cooperarea în domeniul comerțului și investițiilor. De asemenea, sunt examinate provocările cheie cu care se confruntă UE în relațiile sale cu Georgia, cum ar fi instabilitatea politică, conflictele din regiune, corupția și dezvoltarea economică slabă. Sunt prezentate mai multe recomandări pentru consolidarea cooperării între UE și Georgia, inclusiv îmbunătățirea eficacității asistenței financiare, sprijinirea reformelor și combaterea corupției, precum și promovarea soluțiilor pașnice în rezolvarea conflictelor din regiune. În ansamblu, articolul reprezintă o contribuție importantă la studiul politicii est-europene a vecinătății UE și a implementării sale în Georgia.Acest articol se concentrează pe analiza politicii est-europene a vecinătății Uniunii Europene în Georgia.     REFLECȚII PRIVIND DEFICIENȚELE ȘI DISCORDANȚELE NORMATIVE DE NATURĂ SĂ AFECTEZE ASISTENȚA JUDICIARĂ PRIVIND RECUPERAREA BUNURILOR INFRACȚIONALE

    Most of the legal impediments that appears in front of the criminal assets recovery at the international level are the requirements for mutual legal assistance (MLA); excessive banking secrecy; lack of procedures for non-conviction-based confiscation; and excessively difficult procedural and evidentiary laws. Removing legal impediments is obviously essential. Absent a clear and sound legal framework, asset recovery becomes, in a best-case scenario, arduous and, in a worst-case scenario, impossible. Thus, the analysis of the reports of the practitioners in the field at international level, can offer us solutions, which will raise the state to another level.The long process of asset recovery and the low level of cooperation is the best evidence of the shortcomings that stagnate the process of recovering criminal assets.
