Item EVOLUȚIA PROCEDURILOR APLICATE EXCEPȚIILOR DE NECONSTITUȚIONALITATE ÎN REPUBLICA MOLDOVA(CEP USM, 2018) Zaporojan, CorinaItem IMPACTUL CONSTITUȚIONALISMULUI ASUPRA DEMOCRAȚIEI DIRECTE ȘI REPREZENTATIVE ÎN STATUL DE DREPT(Editura ASEM, 2022) Zaporojan, Veaceslav; Zaporojan, CorinaThe development of direct and representative democracy, as the essence of the rule of law, imposes the need to exercise political activities based on the Constitution, but also a control of political activities exercised by the rulers - constitutionalism. Constitutionalism, through the control of constitutionality, allows society to exercise verification of governance measures. Constitutionalism exercises differently the assessment of the sovereignty of the people in the direct and representative execution of the rulers of democracy. The research evaluates through the historical prism of applying the constitutional law and controlling the constitutionality of the processes of exercising direct and representative democracy in developing democracies, such as the Republic of Moldova, in relation to developed democracies. The study found the application of direct democracy to the adoption of the Constitution of the Fifth Republic in France unacceptable. In comparison, the study considered inadmissible the adoption of a law to revise the Constitution through the direct exercise of sovereignty, as attempted in Moldova in the absence of a procedure directly regulated by the Constitution, supported by the indirect agreement of the Constitutional Court. The positive and intense political application, including publicity, of this procedure, guided the people of the Republic of Moldova, through their great thought, to ignore this initiative without even 1/3 of the voters running in the referendum.Item JURISDICȚIA CONSTITUȚIONALĂ PRIVIND NEUTRALITATEA REPUBLICII MOLDOVA(Chișinău, 2023-10-13) Zaporojan, Veaceslav; Zaporojan, CorinaNeutralitatea în dreptul internațional public, ca regim politico-juridic al statului, prin instituirea antimilitarismului, interdicția de a încheia acorduri de alianțe militare, amestecul în conflictele interstatale și susținerea statelor beligerante în situația actuală a războaielor din Ucraina și Fâșia Gaza direcționează guvernarea, cercetătorii și politicul național la dispute largi asupra statutului constituțional de neutralitate al Republicii Moldova. Calitatea constituțională de stat neutru a Republicii Moldova, politic poate fi prezentată drept obstacol pentru perfecționarea sistemului militar național de apărare sau pentru aderarea la Uniunea Europeană. Juridic, utilizând dreptul internațional și constituțional, în baza Hotărârii Curții Constituționale 14/2017 neutralitatea nu poate fi utilizată drept obstacol în ambele cazuri, iar urmând exemplul altor state neutre, precum Elveția, Finlanda sau Suedia, Republica Moldova nu are nici un impediment în dezvoltarea oricăror domenii al statalității, iar în caz de necesitate neutralitatea poate fi eliminată constituțional cu votul majorității cetățenilor înscriși în listele electorale, în 2023 acest număr necesar de a nu fi mai mic de 1.649.273 de alegători.Item LEGAL FRAMEWORK OF SUBJECTS ENTITLED TO APPEAL THE CONSTITUTIONAL COURT(Editura ASEM, 2019-04-24) Zaporojan, CorinaPeople's access to constitutional justice is a controversial and very important issue for our country. The legal framework put in place is not as rigid as in other states, as the Constitution does not explicitly provide for the right of referral of subjects. In other words, the purpose of the Constitutional Court can justify the alleged unconstitutionality of the challenged legal act by legitimate, political, moral or circumstantial arguments. In most countries that have implemented the control model of the European Constitution, the constitutional court has opted for the classical constitutional revision of Kelsen, in which the right of referral is granted only to public authorities.Item PARTICULARITIES OF THE MODEL OF CONSTITUTIONAL JUSTICE APPLICABLE IN THE REPUBLIC OF MOLDOVA(Editura ASEM, 2017-04-28) Zaporojan, CorinaThis article intends to examine the evolution of the constitutional justice applicable in Republic of Moldova, with the establishment of the Constitutional court, analyzing the key differences between European model of Constitutional court and the mechanism created in the Republic of Moldova over the years, while focusing on the concrete Moldavian historical-political background which had an impact on the shaping of the Constitutional Court.Item ROLUL JURISPRUDENȚEI EUROPENE ÎN JUSTIȚIA CONSTITUȚIONALĂ DIN REPUBLICA MOLDOVA(CEP USM, 2022) Zaporojan, Corina; Zaporojan, VeaceslavIn the article, the authors analyze the application of the ECtHR jurisprudence in the CCRM (Constitutional Court of the Republic of Moldova)jurisprudence and its importance for the national constitutional jurisprudence. In particular, its application in the area of human rights has been examined. The impact of the ECtHR jurisprudence on other areas, such as gambling control, free competition, criminal matters, has also been analyzed. The authors determine that there is a growing trend in national jurisprudence in the application of the jurisprudence of the European Court of Human Rights and the Court of Justice of the European Union.
