    Accesul consumatorilor la informaţii privind cerinţele de proiectare ecologică aplicabile produselor cu impact energetic

    Moldova is one of the European countries exposed to energy vulnerability, a si- tuation exacerbated by rising energy prices as a result of the recent energy crisis. In this context, improving energy efficiency by harmonising eco-design requirements for energy-related products, especially in Moldovan households, is essential to mitigate the problem of energy vulnerability at the national level. The main idea of this article is the integration of sustainability principles into consumer protection policies through measures that promote responsible consumption and support the purchase of environmentally friendly products and services. These measures include consumer education and information, support for responsible production and consumption, promotion of the circular economy, and the establishment of sustainability standards and regulations. The amendment of Government Decision No. 750/2016 on the approval of regulations on eco-design requirements for energy-related products, by harmonising EU standards, will contribute to increasing awareness, participation and social responsibility with regard to environmental issues, protecting end consumers and preventing energy poverty.

    Dreptul la informație privind calitatea aerului atmosferic: actualitate și perspective de reglementare juridică [Articol]

    RM legislation contains a variety of regulations which guarantee access to correct information about the environment, but this provisions it is difficult to implement in practice and as a result, population have inefficient information about the real air pollution level. At the same time, these provisions do not comply to the requirements of the International Conventions and EU Directives in terms of public information. In the context of RM legislation reforming towards its harmonization with the EU legislation, author consider, the most optimal for EU directives implementation in RM seems to be the development and adoption of the specific Law on ambient air quality,that would facilitateto promote policies aimed at reducing pollution to levels which minimize harmful effects on human health, paying particular attention to sensitive populations, and the environment as a whole, to improve the monitoring and assessment of air quality including the deposition of pollutants and to provide information to the public.

    Securitatea mediului în regiune și perspectivele dezvoltării durabile al acesteia se află sub amenințare iar această situație s-ar putea agrava datorită acțiunilor autorității Ucrainei, care ignoră normele internaționale.În vederea prevenirii agravării problemelor de mediu, și cu scopul de a îndepărtaposibilile daune provocate mediului și,în special, pentru a preîntâmpina distrugerea ecosistemului Nistru, agențiile pentru sănătate publică, precum și fundamentele economice, nu doar din Republica Moldova și Ucraina, ci și din întreaga regiune a Mării Negre, ar trebui să consolideze eforturile tuturor structurilor și actorilor interesați (inclusiv sectorul neguvernamental), pentru a bloca implementarea programului de extindere a energiei hidroenergetice din Ucraina.

    This article aims at providing the approach towards the problem based on fundamental rule of the legal regime of transboundary waters of the principle of “reasonable and equitable use”, according to which each basin state has the right, to a reasonable and equitable share of the benefits of the use of the waters of that basin.These norms were originally provided for in the 1966 Helsinki Rules for the Use of International River Waters, updated and revised by the International Law Association in another act - the Berlin Rules on Water Resources.Although Article 4 (2) of the Rome Bilateral Agreement (2012) provides for the obligation of the Parties to use the water resources of the Dniester River basin fairly and rationally, it is extremely important that this principle be extended and developed, taking into account the current situation and the perspective of the sustainable development of this basin.

    Verificatorii rapoartelor de emisii a GEF – o nouă instituție juridică în dreptul mediului al Republicii Moldova

    In the scope of implementation of the RM-EU Association Agreement and in conformity with para 97 of their National Action Plan, as well as for the fulfillment of the arrangements taking into account the new RM status of the EU candidate country, in order to reduce GHG emissions in a cost-effective and efficient way, it is necessary to accelerate the harmonization of national legislation with that of the EU standards, inclusive over the existing instruments for mitigating climate change, in particular, some provisions of Directive 2003/87/EC . The elaboration and approval of a special Regulation, an effective regulatory framework will be created to regulate the process of verifying the reports of an installation operator, that generates GHG emissions, presented to the environmental authority, which must become an efficient and reliable tool in support of the control procedures and assurance of quality information provided on GHG emissions. At the same time, the requirement of reliability, established with regard to institutions, can be violated by the operator, and the information included in the report may contain inaccuracies, irregularities and material non-conformities, the need to create a new legal institution is imposed- that of the report verifier submitted to facility operators, who must carry out the verification in the public interest, be impartial and independent of the operator or aircraft operator, as well as the responsible competent authorities.
