    Moldova is a country in transition that’s currently at the intermediate stage of the reforming process of its public institutions, legislation and political agenda. In this context, the country must bring European standards to Moldova to implement reforms, including ensuring the rule of law and fundamental freedoms, developing a vibrant market economy and reducing poverty. The International Labour Organization plays a significant role in this process by promoting decent work conditions so that everybody could work under conditions of freedom, equity, security and human dignity. The ratification and implementation of conventions and international treaties represent a necessity and a way to reach the European standards and values.

    Each of us is or will be employee or employer. From this reason the study and the creation of the best healthy and comfortable working conditions is a priority for both parties. Following the above mentioned, we can say that it is necessary to elaborate and implement a national working program in the health and safety area for the optimization and connection of the work health and safety policy in accordance to the labor standards of the European Union. It should include: goals, objectives and indicators of progress in the safety area of the workplace, implemented by the central and local administration bodies.

    By the confidentiality clause the parties agree that during of the individual employment contract period and after its termination, not to disclose data or information they learned during the employment period. The confidentiality clause is part of the specific terms used in the individual employment contract, having optional character. Failure to comply to the confidentiality clause by the employee is liable for financial compensations, sanctions or even fired due to damages caused to the employer. Key elements of the confidentiality clause are: - period for which takes effect; - information of a confidential nature; - ways in which this obligation will cease; - liabilities of the parties.

    The night work means all work which is performed during a period of not less than seven consecutive hours, including the interval from midnight to 5 a. m., to be determined by the competent authority after consulting the most representative organisations of employers and workers or by collective agreements. It is necessary to take specific measures required by the nature of night work, which shall be taken for night workers in order to protect their health, assist them to meet their family and social responsibilities, provide opportunities for occupational advancement, and compensate them appropriately. Such measures shall also be taken in the fields of safety and maternity protection for all workers performing night work.
