    The right to defense is a fundamental right not only in the general matter of human rights, but also in the field of contravention law, criminal law, civil law etc. We must keep in mind that the right to defense must be ensured for any party, at any stage of the process. Referring to the defense counsel, the contravention legislation expressly recognizes their starut to the lawyer, and we will reveal his particularities along the way. The ECHR has repeatedly stated that ensuring the right to defense is also a guarantee of ensuring the right to a fair trial. In this article we aimed to elucidate the importance of ensuring the right to defense in the contravention process, but also we tried to make an analysis of the contravention legislation in terms of expressly addressing this right.

    This article presents the analysis of the crime of rape as the most serious form of attack on a person’s sexual freedom and inviolability. We highlighted the essence of the stages of criminal activity in the case of rape, but also the effects of the adoption of Law no. 316/2022 for ensuring the rights of victims in the case of crimes regarding sexual life and family violence, having direct repercussions on the subject under investigation.

    PREVENIREA ȘI COMBATEREA TRAFICULUI DE COPII

    Child trafficking is a crime that goes beyond any limits. The factors that influence the development of this phenomenon are: the development of information technologies, globalization. The Covid-19 pandemic has accelerated some processes that facilitate the continuous development and create favorable conditions for the realization of alternative harmful actions provided by the incrimination norm. Likewise, the pandemic situation has influenced and highlighted some serious problems in society and at the level of public authorities. Prevention, as a goal of criminal law, can be achieved through public information, training with employees who have direct contact with children or parents of children, social guidance, etc. In this sense, there are several directions in which state representatives urgently need to take decisive action. In order to protect children from the risk of trafficking, viable social and economic protection services for families and parents must be created, as well as alternative services for identifying families and children at risk and mechanisms for early and sustainable intervention.
