    Legitima apărare în dreptul penal al Republicii Moldova [Articol]

    Self-defence represents an institution eliminating the criminal nature of an act, therefore the criminal liability of the individual who comitted it. It is regulated through Article 36 of the Criminal Law. Self-defence is based on several components: the need for defence, desire to protect social values against any harm, presence of an attack and mental processes taking place within the person under attack inhibiting the ability of free will manifesting.
