Ideile și concepțiile științifice de o valoare netăgăduită privind infracţiunile, ce sunt prevăzute la art. 236 din Codul penal al Republicii Moldova, au fost valorificate de către: V. Berliba; S. Brînza; R. Cojocaru; L. Gîrla; C. Gurschi; V. Stati; Iu. Tabarcea (Republica Moldova); F. Duvac; N. Neagu; I. M. Rusu (România); V. Ivașcenko; I. M. Mihailov; I. V. Sângaivska (Ucraina); I. E. Maksimova (Rusia). Acești doctrinari își îndreaptă privirea cu preponderență asupra problemelor de natură juridico-penală ale fabricării sau punerii în circulaţie a semnelor băneşti false sau a titlurilor de valoare false, care nu pot fi ignorate în procesul perceperii naturii juridice a răspunderii penale pentru fabricarea sau punerea în circulaţie a semnelor băneşti false sau a titlurilor de valoare false.
OBIECTUL JURIDIC SPECIAL AL INFRACȚIUNILOR PREVĂZUTE LA ART. 236 DIN CODUL PENAL: CLARIFICĂRI CONCEPTUALE

Establishing the legal nature of the offenses, provided for in art. 236 of the Criminal Code of the Republic of Moldova is not possible without determining the special legal object of these offenses. Only by identifying the particular social value damaged because of co mitting the offenses of production or putting into circulation of counterfeit money or securities, can we understand whether: it is appropriate or not to place these offenses in Chapter X of the special part of the Criminal Code; is the provision of art. 236 of the Criminal Code of the Republic of Moldova correctly formulated or not? As a result of the performed study, it is established that the special legal object of the offenses provided for in art. 236 of the Criminal Code of the Republic of Moldova is formed by social relations regarding the production or circulation of authentic cash notes or securities.

As a social value defended against the offenses provided for in Chapter X of the special part of the Criminal Code of the Republic of Moldova, the national economy includes all economic activities, such as the production, consumption, distribution and exchange of goods, services and works, which are carried out on the territory of the Republic of Moldova. It encompasses all economic sectors, resources, markets, institutions that contribute to the well-being and sustainable development of the Moldovan society. The manufacture or circulation of counterfeit currency or securities may be directly related to inflation. When the number of such crimes increases, the value of genuine banknotes decreases, which can lead to inflation. Also, the capital market may be adversely affected, contributing to economic instability. The purpose of art. 236 of the Criminal Code of the Republic of Moldova is to defend the national economy of the Republic of Moldova. Defending it, art. 236 of the Criminal Code of the Republic of Moldova provides protection to the national economies of other states in some cases.
