    COPARTICIPAREA PROCESUALĂ ÎN LUMINA CODULUI DE PROCEDURĂ CIVILĂ AL REPUBLICII MOLDOVA

    This article analyzes the ways in procedural co-participation and the reasons of admitition by court in settling the Civil Procedure Code of the Republic of Moldova. Particular attention was made over difference procedural co-participation from other institutions of civil procedure.There are interpreted certain notions of art. 62 and art. 63 of the Code of Civil Procedure of RM which is a condition of correct application of the provisions mentioned. Also were identified certain imperfections allowed by the legislator in regulating this legal institution.

    Declararea inadmisibilității acțiunii în contenciosul administrativ și refuzul de a primi cererea de chemare în judecată ca efecte procesuale dublate

    In this article, two effects of the violation of the rules of the court's general jurisdiction were analyzed: the declaration of the inadmissibility of the action in the administrative litigation and the refusal to receive the summons request. These two procedural effects may have other grounds for their birth, but they have been analyzed from the perspective of the violation of the rules of general competence because they have the most tangents between them and to prove that they are essentially the same. In order to prove the similarity of these two procedural effects, both the provisions of the Administrative Code of the Republic of Moldova and the provisions of the Civil Procedure Code of the Republic of Moldova were analyzed. The introduction of the notion of declaring the action inadmissible in administrative litigation into the Administrative Code of the Republic of Moldova was criticized. Finally, it was proposed to exclude it from the Administrative Code of the Republic of Moldova.
