The need to establish criminal liability for home violence is dictated by the social importance that constitutional law has on the inviolability of the domicile and the reports that are formed in the exercise of this right.In its turn, the European Community has adopted the European Convention on Human Rights which, in Article 8, paragraph 1, enshrines the right of the individual to have a place of residence, that is to say a freely chosen place, where to live his personal life without the unwanted interference side of others.The private life of any person develops through regular reports at his / her home, the space where he / she is performing under the most intimate one.
SĂVÂRȘIREA INFRACȚIUNII DE VIOLARE DE DOMICILIU CU APLICAREA VIOLENȚEI SAU CU AMENINȚAREA APLICĂRII EI

Domiciliul reprezintă spaţiul de libertate în care o persoană îşi desfăşoară cea mai mare parte a vieţii sale private şi familiale şi a cărei ocrotire este indispensabilă într-o societate democratică. Articolul conține analiza juridico-penală a agravantei specificate la art.179 alin.(2) CP RM ,,pătrunderea sau rămânerea ilegală în domiciliul sau în reşedinţa unei persoane cu aplicarea violenţei sau cu ameninţarea aplicării ei”. Cercetarea constituie un studiu realizat în scopul consolidării materiei penale ce ajută la încadrarea și delimitarea agravantei respective de celelalte agravante specificate la art.77 CP RM și de alte infracțiuni conexe. Scopul lucrării constă în aprofundarea concepţiei de aplicare a legii ce prevede răspunderea pentru infracţiunea de violare de domiciliu în condiţiile în care încurajarea şi promovarea respectului pentru drepturile omului şi libertăţile fundamentale cons tituie caracteristici ale democraţiei în devenire din Republica Moldova.

The act of committing acts of violence or threatening the use of the aforementioned activities in a household is a social security issue. Thus I consider it necessary that the le- gislator to tends a high degree of care in this prospect as it can create impartial judicial practices. The development of the private life of a person is through the different aspects in- cluding at the place of residence. Proper communication in the family, spiritual growth and a fulfilling daily life is a contributing factor to the moral maturation of a individual so that he can function as an independent citizen. The need to establish criminal liability for home vi- olence is dictated at the same time by the social importance of the inviolability of the home, making it a constitutional right. This assignment is a study to identify and a quantification of the impact domestic violence or the threatening with has ( art. 179 par.(2) Criminal Code RM). The stated criminal offense may create a unpredictable individual, which can make irrational decisions that can affect the one who is the instigator of the situation, and the sufferer, out of which both can create circumstances where unpredictable harm is dealt.
