Item ARGUMENTAREA IMUNITĂŢII JUDECĂTORULUI ÎN REALITATEA JURIDICĂ NAŢIONALĂ(2012) Poalelungi, Mihai; Negru, AndreiThe paper is a complex analysis of the national reform in field of justice that contains a great number of normative modifications in the relevant legislative acts, inclusively concerning the judge’s immunity. The authors explain, from an objective and absolutely professional point of view what are the risks of such a decision in our state and how the mentioned situation may affect the quality and the efficiency of justice, the people’s confidence in the act of justice, the independence and impartiality of justice in general and of magistrates in part. Maybe the actual Government does not realize that the risks are major, because there cannot exist a limited independence or impartiality; in such conditions the political interference in the field of justice may become a mechanism to control and influence justice as one of the three state powers and magistrates in taking decisions. It would not correspond to the fundamental principles specific to justice and to the exigencies of a state of law. The authors try to preview the impact of limiting judges` immunity on the justice in functional, institutional and organizational aspects and recommend the National Supreme Court of Magistracy to assume responsibility and manifest activism in consulting the competent state power representatives on the discussed problem, for preventing the risk to have the juridical authority completely influenced and controlled by the political forces in the state. Guaranteeing immunity and independence to justice as an authority, as a system of instances and as a body of magistrates is one of the most important premises of a consolidated justice; the judges` immunity may be limited only in a nondemocratic and sick society, but the democratic government, on the contrary, is a propitious field to discover the axiological essence of consolidated justice.Item PROVOCAREA ORGANIZATĂ ÎN CONTEXTUL JURISPRUDENŢEI CURŢII EUROPENE A DREPTURILOR OMULUI(2018) Scobioală, Diana; Poalelungi, MihaiÎn prezentul demers ştiinţific autorii au efectuat o analiză a conceptului provocării organizate în lumina jurisprudenţei degajate de Curtea Europeană a Drepturilor Omului, reliefând esenţa acesteia, particularităţile, principiile generale de organizare şi desfăşurare a operaţiunilor speciale ale agenţilor statului, precum şi garanţiile procesuale inerente dreptului la un proces echitabil în contextul respectiv. Au fost scoase în vizor principalele cauze în care forul contenciosului european s-a pronunţat asupra provocării organizate de către forţele poliţieneşti, un loc separat revenind jurisprudenţei dezvoltate versus Republica Moldova.Item Ultra vires și depășirea competențelor curții de justiție a Uniunii Europene în lumina spețelor Junk vs. Kühnel și Mangol vs. Helm(Editura USM, 2024) Poalelungi, MihaiThe subject of the scientific research are the ultra vires acts of the Court of Justice of the European Union analyzed from the perspective of the Republic of Moldova in connection with its submission of the application for accession to the European Union. National legal preparation tends to maintain a vigilance both in temporal and in the light of jurisdictional actuality. Thus, the confrontations of the Court of Justice of the European Union with that of the Constitutional Court of the Federal Republic of Germany, whose magistrates are considered modern titans of European courts, are analyzed. The presentation of the reasoning in concreto serves to raise legal awareness in the Republic of Moldova both for national legal education as well as for national courts. Ultra vires acts are not a novum. However, it is a rarity and can be analyzed deeper in a multi-layered system of law, such as that of the European Union. This research provides the national jurisprudence with a legal "memorandum".
