Item APRECIEREA LIBERĂ A PROBELOR – AREALUL DE MANIFESTARE A PRINCIPIILOR DE INDEPENDENȚĂ ȘI IMPARȚIALITATE A JUDECĂTORULUI(CEP USM, 2020) Lupaşco, LiliaThe purpose of this article is to present and explain the concepts of “appreciation of evidence” and “the independence and impartiality of the judge” when adopting the solutions by the substantive court. The legal-criminal analysis is combined with some references from constitutional law, the general theory of law as well as from judicial practice. The author intends to provide a critical analysis, in comparative plan of the concepts stated through the prism of the principles and guarantees of the activity of the judge, the legal provisions in force as well as the decisions of the Constitutional Court. Also, in this regard, the author will describe the problems and solutions from the perspective of the following topics, applying the comparative methods from the legislation of international authorities.Item APRECIEREA PROBELOR LA ADOPTAREA HOTĂRÂRILOR PROCESUALE ÎN CURSUL CERCETĂRII JUDECĂTOREȘTI(Î.S. „Tipografia Centrală”, 2022) Lupaşco, LiliaProcesul penal manifestă un caracter etapizat, iar fiecare dintre fazele procesului vizează rezolvarea anumitor chestiuni şi finalizează cu adoptarea unor soluţii corespunzătoare. Aprecierea probelor în cursul cercetării judecătorești manifestă interes, întrucât aici se pun bazele activităţii organului judiciar pentru etapa următoare. Cercetarea judecătorească constituie partea centrală a judecării cauzei în prima instanţă. În cursul cercetării judecătorești părţile pot să administreze probe, iar organului judiciar îi revin o serie de obligaţii în legătură cu aprecierea probelor. Pentru aflarea adevărului, organul judiciar va supune aprecierii toate probele din dosar.Item SENTINŢA JUDECĂTOREASCĂ – ACTUL FINAL AL APRECIERII PROBELOR(CEP USM, 2021) Lupaşco, LiliaIn the criminal procedural law of the Republic of Moldova, the court sentence is regulated in different contexts and with various names. The sentence is adopted in the name of the law. The adoption of the sentence in the name of the law increases the degree of authority of this act, as well as the responsibility of the judge in connection with the pronouncing of an unfounded decision. In this connection, it was mentioned that the sentence issued in the name of the law is, in fact, similar to the law in terms of obligation for the persons it concerns. The court sentence is the act of final synthesis of all the legal norms that were applied by the subjects of the criminal case in all the stages through which it passed. In these stages, the court forms its personal opinion with reference to all the evidence collected during the criminal case. Despite the fact that sometimes the judge’s point of view may differ from the opinion of the other members of the panel, the main task is for the evidence to be assessed objectively. In the sentence, the court will highlight the reasons that determined the admission or rejection of the evidence, administered by both the prosecution and the defense, having the obligation to assess the entire evidence.
