    Asigurarea libertății de gândire, conștiință și religie în Republica Moldova [Articol]

    The religious life is studied from many perspectives (inter-confessional, ideological, confessional, secular, legal,constitutional, etc.). The present study has a „general” character identifying the constitutional issues regarding the freedom of conscience. We consider that a detailed analysis of the relationship between the state and religious cults can make a significant contribution for understanding some realities that are crucial for the free and unconditional manifestation of the faith of the citizens.

    ASPECTE CONCEPTUALE PRIVIND LIBERTATEA DE RELIGIE ȘI LIBERTATEA DE CONȘTIINȚĂ

    Acest articol discută dificultățile cu care ne confruntăm în definirea exactă și în detaliu a conștiinței și religiei - în condițiile unei diversități religioase extinse. Conceptele de conștiință și religie nu trebuie să fie părtinitoare față de religiile “occidentale”, creștine sau alte religii existente. În acest articol, încercăm să demonstrăm că avem nevoie de un astfel de concept pentru scopuri practice și științifice, cu scopul de a pune capăt legăturii dintre sociologia “modernă” a religiei și o filosofie politică predominantă a ”conștiinței” care a legitimat “secularizarea societăților” și a dus la apariția unui “stat secular”. Prin urmare, în articol se discută dacă este posibil să se dezvolte concepte critice privind libertatea de religie și libertatea de conștiință, precum și raportul acestora între ele. La fel, dacă este posibil ca aceste concepte să primească o înțelegere universal acceptată de toate statele, dincolo de interpretările istorice care vin din cultura occidentală, din creștinism, catolicism, ortodoxism sau protestantism.

    Compatibilitatea legislației naționale privind libertatea de conștiință cu standardele internaționale [Articol]

    By rallying the Republic of Moldova to international standards and the european instruments, it has committed itself to respect the human rights and freedoms. Thereby, the freedom of conscience is a fundamental right that is guaranteed both by international and national laws. This article analyzes the European and Moldovan regulations and shows their compatibility.

    Libertatea de conștiință – aspecte teoretice în contextul nediscriminării [Articol]

    The essence of the protection of the freedom of conscience is really important in the Republic of Moldova, in the context in which the transition was not a factor for the consolidation of the society, but a stage of passing from totalitarian system to a democratic one. The gaps of transition were reflected deeply in the individual's relationship with his own belief. Freedom of conscience has overlapped the freedom to manifest without fear of being discriminated against by religious belief. Therefore, in the ex-socialist societies, the value of freedom of consciousness has to be more thoroughly analyzed, for the supreme law and laws to cover the whole spectrum of problems existing in the given field.

    Unele consideraţiuni cu privire la problema libertăţii de gândire, conştiinţă şi religie tratată în filosofie, teologie şi jurisprudenţă şi implicaţiile asupra jurisprudenţei [Articol]

    This article discusses the issue of the interaction between freedom of thought, freedom of conscience and freedom of religion in the context of a democratic society. The author analyzes the philosophical, theological and legal dimension of these percepts, emphasizing that there is a dialectical connection between them. At the same time, there are analyzed the implications of these types of freedoms on the jurisprudence of the European Court of Human Rights.
