Item Dreptul de acces la funcția de judecător la Curtea Supremă de Justiție: aspecte de constituționalitate și securitate juridică(Editura USM, 2024) Iacub, IrinaThe study includes a detailed analysis of the right of access to the position of judge at the Supreme Court of Justice, a highly topical subject at the moment, as we are in the process of completing the staffing of this authority. The study focuses on the analysis and elucidation of the essence and content of the given right, the conditions for exercising it and the specifics of its restriction. Distinct attention is paid to the way in which the restriction of its exercise, regulated by the legislation in force (in particular by Law no. 65/2023 and Law no. 64/2023), corresponds to the constitutional requirements in this field. Additionally, it is assessed how the regulation of its exercise guarantees the legal security of its holders.Item Eroarea judiciară: concept și reglementare [Articol](CEP USM, 2024) Iacub, IrinaThe study is focused on the issue of judicial error as a concept and legal category. Starting from the constitutional text, in which the notion of “error” is attested, and the legislation that develops it, an attempt is made to clarify its meaning, taking into account the lexicographical explanations from explanatory dictionaries and those of legal terms. The main conclusion is focused on the idea that the judicial error, which includes in itself the error of fact and law (even if only one of them), can be admitted as a result of the violation of material or procedural rules, which denotes that it essentially represents an action/ illegal inaction.Item GARANTAREA CONSTITUȚIONALĂ A RESTRÂNGERII DREPTURILOR FUNDAMENTALE ALE OMULUI CA DIMENSIUNE INERENTĂ SECURITĂȚII JURIDICE(CEP USM, 2024) Iacub, IrinaArticolul cuprinde un studiu succint asupra instituției restrângerii exercițiului drepturilor și libertăților fundamentale ale omului, ca dimensiune inerentă securității juridice, sub aspectul garantării constituționale, alături de alte instituții juridice asemănătoare. În principal, este analizat conținutul art. 54 din Constituția Republicii Moldova, care în timp ce interzice suprimarea și diminuarea drepturilor omului, permite restrângerea exercițiului acestora în cazuri și condiții strict stabilite. Scopul urmărit privește clarificarea principalelor reguli constituționale de care trebuie să țină cont atât legiuitorul, cât și practicianul dreptului atunci când recurge la restrângerea exercițiului drepturilor omului, pentru a preveni astfel subminarea, diminuarea și încălcarea acestor valori supreme într-un stat de drept.Item O nouă dimensiune aplicativă a criminologiei contemporane(CEP USM, 2024) Iacub, IrinaThe study focuses on highlighting the role of criminology and the criminologist in contemporary society. Starting from the special significance of criminology in the realization of the state's anti-crime policy, the paper emphasizes the need to extend the use of its results to new important areas of state activity. Specifically, it proposes extending forensic criminological expertise from draft legislation to legislation already in force. In support of this proposal, it gives examples of the possible benefits that can be obtained in a rather sensitive area of our society: the judiciary and the act of justice.
