    DREPTUL LA VIAȚA PRIVATĂ ÎN ERA DIGITALĂ

    In this article we will analyze how the process of development in digital communi- cations has facilitated the protection of human rights on the one hand, but also admitted interference in the right to privacy. How these processes are regulated at the level of the international legal framework and examined individual cases at the European Court of Human Rights. We will present conclusions and opinions on how the jurisprudence of the Court once implemented by states can raise the level of protection of democratic rights.

    IMPORTANȚA DREPTULUI LA VIAȚA PRIVATĂ ÎN LUMINA CONVENȚIEI EUROPENE A DREPTURILOR OMULUI

    Since the adoption of the European Convention on Human Rights, the European Court of Human Rights has examined a large number of complaints in which the applicants raised issues of violation of the right to respect private and family life in various aspects. A particular feature of Article 8 of the Convention is it contains both guarantees of the enforcement of the law and the restriction of the right to respect for private life. According to the Article 8 of the European Convention on Human Rights, Everyone has the right to respect for his private and family life, his home and his correspondence.

    VIAŢA PRIVATĂ PRIN PRISMA CONVENŢIEI EUROPENE A DREPTURILOR OMULUI ÎN CAZURILE MOLDOVENEŞTI

    Prezenta lucrare aduce în evidenţă câteva cazuri împotriva Republicii Moldova examinate la Curtea Europeană a Drepturilor Omului în care au fost invocate încălcarea articolului 8 din Convenţie. Am prezentat deciziile şi argumentarea Curţii. A fost analizate şi prezentate chestiunile cheie care au fost abordate pe parcursul executării deciziilor prin analiza rapoartelor şi comunicărilor prezentate de Guvernul Republicii Moldova la Comitetul de Miniştri a Consiliului Europei. Am urmărit evoluţia modificărilor legislaţiei şi practicii naţionale care a survenit în rezultatul adoptării acestor hotărâri ale Curţii.
