Furthermore, everyone can equally participate in political, economic, social and cultural life, without discriminations, equally treated by all the public authorities and citizens. The principle of equality requires for equal situations to be applied an equal legal treatment, same as, implies the right to differentiation in legal treatment, because once the equality is not natural, imposing an equal treatment would lead to discrimination. In other words, to equal situations should correspond an equal legal treatment and to different situations – the treatment should be different.Item EXERCITAREA DREPTULUI DE PROPRIETATE ASUPRA TERENURILOR DE CĂTRE CETĂŢENII STRĂINI (STUDIU COMPARAT)(2008) Slusarenco, Svetlana; Cobăneanu, SergiuThe number of actual regulations’ landings concerning the foreign citizens’ right for holding lands is remarkable. This thing is not surprising taking into consideration that this problem is not ruled by the International Law and there are no multilateral conventions concerning the utilization and holding land by the foreign citizens. The International Law does not limit the right of the states to restrict or regulate the property of foreigners over land on their territory. The states derive advantage from the sovereignty of their natural resources, including land. The land is not only an element of a state to exercise sovereignty over it is also a fundamental resource. The overwhelming majority of the states have a restrictive attitude towards the right of the foreign citizens to hold the property over land. Other states retracted from such restrictions adhering to the European Union. Also it has to be said that the holding of the propriety over land by the foreign citizens show as well benefits and risks.Item UNELE CONSIDERAŢII PRIVIND DESCENTRALIZAREA FINANCIARĂ(2008) Cobăneanu, Sergiu; Televca, OlegThe centralization and decentralization problem in public administration is raised in every state, without taking into consideration its structure, form of government form or political regime. An imperious, in order to assure a consecutive and efficient process of decentralization in Republic of Moldova, is to create a coherent legal basis which would contain a real mechanism of decentralization and would establish its implementation stages. A clear strategy is needed, with a concrete plan of measures for an efficient implementation of decentralization at different levels: central, regional and of local community.
