Item ANGAJAMENTELE SERVICIULUI DE INFORMAŢII ŞI SECURITATE AL REPUBLICII MOLDOVA ÎN PREVENIREA ŞI CONTRACARAREA TERORISMULUI(CEP USM, 2016) Bencheci, Marcel; Pîrţac, Grigore; Hîrbu-Bencheci, DianaUnder the national law, the Intelligence and Security Service (SIS) of the Republic of Moldova has one of the most important place in the system of state security. The law on Combating Terrorism designates SIS as a national authority to combat terrorism. Its text shapes contact institution with security structures of the European Community with which it established relationships. Talks were also held with representatives of the management Security Directorate of the European Commission and the Security Office of the General Secretariat of the EU Council. Policy makers operating to fight terrorism are geared towards constantly identifying, monitoring and evaluating risks and trends, as well as terrorist threats to the national security of the Republic of Moldova, protecting national territory, citizens and foreigners who visit our country, preventing the involvement of Moldovan citizens and foreign residents in activities related to international terrorism, prohibiting the creation and functioningof the bases for training and rehabilitation of terrorists, participating in international efforts to prevent and counter terrorism. In combating international terrorism, Moldova has a priority to ensure close cooperation with similar bodies in other countries and, in particular, organizing collaboration and information exchange with Europol, Interpol and other relevant institutions responsible for the preventing and neutralizing actions committed by international terrorist organizations that could penetrate into the territory of Moldova.Item ASPECTE ALE COMBATERII TERORISMULUI PRIN INTERMEDIUL ORGANIZAȚIILOR INTERNAȚIONALE DE SECURITATE(2018) Bencheci, Marcel; Bencheci, Diana; Gorincioi, IuliaThe profound transformations at the beginning of the 21 century, characterized by political changes and the diversification of geostrategic interests, significantly influence the evolution of the international security system. The cutting-edge events in Ukraine and Syria show that it has a significant change, including the trends of strategic reconfiguration of partnerships between different international security organizations, depending on the interests and security objectives of the main actor. Also the major threat to security is terrorism. Under the international security system, international security organizations are the most complex forms of international government co-operation. International organizations have become an important element of the international security system, especially after the Second World War, when their number began to rise considerably. Globally, the number of international organizations is particularly high, so it is difficult to determine the specific role which they play.Item ASPECTE DE DREPT INTERNAȚIONAL IN CONTEXTUL CONFLICTELOR INGHEȚATE: CAZUL TRANSNISTRIEI(Fox Trading, 2020) Bencheci, Marcel; Hîrbu, Diana; Cujbă, VasileThe subject of applicable jurisdiction in relation to members of the armed forces of the Russian Federation stationed on the territory of the Republic of Moldova is under the agenda of public international law.Given that the principle of sovereign equality of states is one of the fundamental principles in public international law, each state retains the right to exercise its jurisdiction in relation to persons and property located in or outside the contry. Under these conditions, a single solution cannot exist, as such situations are governed by international agreements, including bilateral and multilateral ones. Intarnational agreements may provide for the application of state jurisdiction under certain conditions, the requirements for the surrender and extradition of persons, the esteblishment of Commissions of Inquiry or Conciliation for the purpose of setting conflict situations, etc.Item CAPABILITAȚI INSTITUȚIONALE DE CONTRACARARE A RISCURILOR ȘI AMENINȚARILOR CU CARACTER TERORIST(Institutul de Cercetări Juridice şi Politice al AŞM, 2019) Bencheci, Marcel; Bencheci, DianaActualul mediu de securitate internațional este dictat în mod constant de confruntarea dintre interese geostrategice, valori, credințe și percepții, democrație și totalitarism, rețele transnaționale de terorism criminale și forțe politice raționale în statele implicate în procesul de democratizare. Aceste dihotomii creează o societate complexă, dinamică și contradictorie care afectează în mod direct stabilitatea sistemului de securitate internațională. Contextul relațiilor internaționale la începutul secolului XXI arată că măsurile de consolidare a sistemului internațional de securitate trebuie să se bazeze pe dezvoltarea unui sistem internațional și regional de securitate colectivă. The situation that has arisen recently in the post-Soviet space, including audiovisual informational re-sources from the Russian Federation, has begun to have a particularly negative impact on the observance of human rights, state security, and the consolidation of the status of a sovereign, independent, and integral state. The effects of cybercrime on national security derive from the way technology is used by hostile elements and malicious individuals. The development process is closely related to the orientation of the Republic of Moldova towards European values and principles, with the declaration in 2005 of the foreign policy vector of integration into the European Union. This approach to European principles and values was determined by regional and international developments and had a significant impact on the national security system. The use of cutting-edge technologies, such as artificial intelligence and intrusion detection systems, is crucial for protecting critical infrastructure. Additionally, updating laws in this field and enforcing strict regulations are essential for deterring and sanctioning cybercrimes. International cooperation on legislation can also improve the efficiency of prevention and combat measures. Raising awareness of risks and protective measures among citizens and employees can prevent many cyberattacks, and cybersecurity awareness and training programs should be prioritized to reduce vulnerabilities. By adopting these measures, cybercrime prevention can become a fundamental pillar of national security, protecting critical infrastructure and ensuring national stability and safety.Item SECURITATEA FRONTALIERĂ A REPUBLICII MOLDOVA ÎN CONTEXTUL MEDIULUI ACTUAL DE SECURITATE(Institutul naţional de informaţii şi securitate „Bogdan, întemeietorul Moldovei”, 2022-05-14) Buzev, Diana; Bencheci, Marcel; Hîrbu, DianaRepublic of Moldova's immediate rapprochement with the European Union has made it inevitable to reconfigure the relevant security policies, in accordance with those of the EU. A separate approach is also the case of securing the state border. The issue of ensuring border security and the effective regulation of increasingly intensive cross-border flows is facing several countries. At the same time, the processes of global and regional integration are gaining momentum. This study aims to investigate the level of security of the Republic of Moldova in the context of Integrated State Border Management as the main tool that facilitates border control, information exchange and cooperation at national and international level.
