    ASPECTUL JURIDIC UNIVERSAL AL DREPTURILOR OMULUI

    The concept of human rights is known in the sense of fundamental and inalienable rights essential to the human being. The development of human rights on the international level is a innovation in modern international law. The promotion and encouragement of respect for human rights and fundamental freedoms for all without distinction as to race, sex, language or religion is listed in Article 1 of the UN Charter as one of the goals of the United Nations Organizations. Human rights on the universal level are reflected in the provisions of the Universal Declaration of Human Rights passed by the UN General Assembly on 10 December 1948, in the 1966 Covenants and more than 40 international documents. In the field of human rights the United Nations in 1946 set up a Commission on Human Rights to promote international human rights. In 2006 the Commission on human rights have been eliminated and replaced it a new body with modified membership rules known as the Human Rights Council. The human rights conception is a dynamic process reflected in the elaboration of documents at universal and regional level and its implementation.

    Problema privind proliferarea armelor de distrugere în masă este în strânsă conexiune cu multiplele căi de transport (terestru, aerian, maritim). În mod special este accentuat abuzul posibil în cazul transportului maritim. În vederea combaterii proliferării armelor de distrugere în masă a fost elaborat proiectul ,,Inițiativa de Securitate în domeniul Proliferării” (PSI), care a găsit susținere și aplicare din partea majorității statelor lumii.

Posibilitatea deţinerii armelor de distrugere în masă de către entităţi teroriste, ameninţările şi provocările din partea statelor care sfidează normele de drept internaţional necesită consolidarea eforturilor în domeniul securităţii globale.

    Scopul şi obiectivele lucrării. Cercetarea presupune elucidarea modalităţilor legale de protecţie a drepturilor lucrătorilor migranţi pe întreaga perioadă a ciclului migraţional, care reies din diverse acte semnate de către lucrătorul migrant, din actele normative ale statului gazdă şi cele internaţionale. Pentru atingerea acestui scop au fost trasate următoarele obiective: studiul fenomenului migraţiei forţei de muncă, a componentelor sale definitorii, corelaţia dintre migraţie şi globalizare; analiza complexă a mecanismelor legale de protecţie a lucrătorilor migranţi pe care le au la dispoziţie statele şi perspectivele de implementarea a acestora; abordarea politicii migraţionale a Republicii Moldova.

    The practical implementation of preventive diplomacy plays an important role of for ecasting theory. The forecast means knowing in advance, foreseeing a certain event or phenomenon which may result in the optimization of management, development planning, design solutions.Being applied in the most diverse spheres of human activity as the economy, scientific and technological progress, demographic process, education, the value of international forecast as international relations and international law is becoming more and more obvious. Orientation for the future of international law is consistent with the policy of pre-emptive nature of the state and at the same time preventive diplomacy.
