Item ANALIZA CRIMINOLOGICĂ A COMPORTAMENTULUI CRIMINAL SUB FORMA DE “MANIFEST”(CEP USM, 2021) Şavga, Alina; Pozneacova, VeronicaThe complexity of the criminal phenomenon is manifested by the presence of many factors that encourage a person to commit a crime. One of the criminological theories that explain the motivation of criminal behaviour is The New Criminological Theory. This theory analyzes the reasons which encourage a person to commit one of the gravest crimes. These offences are committed as a form of protest against the existing social order. For example, terrorist acts represent the crime, that is committed to change the contemporary social structure. This article is a study dedicated to analyzing the New Criminology Theory. In this context, we highlight the essence of the concept of crime as a manifest. These crimes are based on philosophical, political and religious ideas. This research paper focuses on the formulation of the features characteristic of these crimes.Item CONDAMNAREA INFRACTORULUI – O MĂSURĂ SUFICIENTĂ DE SATISFACȚIE ȘI COMPENSARE A PREJUDICIULUI MORAL CAUZAT VICTIMEI INFRACȚIUNII ?(CEP USM, 2022) Şavga, AlinaUndoubtedly, the conviction of the offender is an important measure of protection of the social values promoted by the state and also constitutes a fair moral satisfaction for the victim, but at the same time, it is not enough when material or moral damage is also inflicted to the victim. A justice in which the damage caused to the victim is not completely recovered, and where the offender is sentenced to prison, can only count as an incomplete form of justice or as a breach of equity. The offender’s conviction is important for the re-establishment of social justice and for the fulfillment of other goals proposed by the lawmaker during the process of criminal punishment, such as: the correction and resocialization of the offender; general and special deterrence; but not to achieve the principle of “restitutio in integrum” for the victim of the crime.Item MPACTUL REGIMULUI SANCȚIONATOR FAVORIZANT ASUPRA PROCESULUI CRIMINOGEN(CEP USM, 2020) Şavga, AlinaDuring the last years of the XX century the process of global humani- zation of the society has been extended over the whole domains of activity and exis- tence, being changed the essential social relationships and legal institutions. The promotion of equal rights between both genders became one of the key elements of the current social system. The society is now facing a „crisis of masculinity”, a problem which is only growing more and more pressing.
