Obiectivul acestui articol este de a analiza şi evidenţia unele criterii obligatorii pentru existența stării de legitima apărare, definite în Codului penal al Republicii Moldova. Noțiunea de bază fiind atacul, privit ca acțiunile sau comportarea violentă a omului îndreptate împotriva valorilor sociale ocrotite de lege. Sunt definite condițiile atacului, enumerate în textul normei privind legitima apărare, conform căreia atacul trebuie să fie direct, imediat, material și real. Totodată, sunt evaluate condiţiile atacalui şi limitele acestuia în vederea exoneării de răspundere penală.The institution of legitimate defense is one of the oldest institutions of criminal law, given the fact that the possibility of causing harm to another in defense of life, health, property, but also the rights and legitimate interests of other persons is a natural right of the person, as well as the right to life. The objective of this article is to analyze and highlight some mandatory criteria for the existence of legitimate defense, defined in the Criminal Code of the Republic of Moldova. The basic notion being the attack, seen as the violent actions or behavior of man directed against social values protected by law. The article defines the conditions of the attack, listed in the text of the norm on legitimate defense, according to which the attack must be direct, immediate, material and real.
