This crime is highlighted by certain features: 1) it involves an activity aimed at committing other, more serious crimes against state security; 2) this germinal activity is criminalized separately, not in the context of the norms that provide liability for these other crimes against state security. It can thus be noted that, in art. 3382 of the Criminal Code of the Republic of Moldova, the activity of conceiving a crime was equated with a consummated crime.More precisely, in art. 3382 of the Criminal Code of the Republic of Moldova, it is criminalized as a distinct crime either the externalization of the desire to commit one of the crimes provided by the art. 337, 338, 3381 or 3401 of the Criminal Code of the Republic of Moldova, or the preparation of one of these crimes.
