Legislators all over the world have made active interventions in the field of this kind of clauses; judges have been found in all jurisdictions to declare liability related clauses unenforceable, on the basis of mandatory provisions of law. In the present article we have analyzed the specific features, the typology and the conditions of the validity of the contract clauses regarding the exemption and the limitation of liability for breach of the contract in various legal systems and instruments of uniform law.В международных коммерческих контрактах, в силу принципа свободы договоров, создаётся большое большое разнообразие условий об ответственности, в зависимости от соответствующего экономического потенциала договаривающихся сторон и иx умения вести переговоры. Законодатели разных стран активно вмешиваются в эту область; судьи в различных правовых системах, на основании императивных норм, зачастую признают такие условия недействительными. В настоящей статье проанализированы характерные черты, основные виды и условия действительности договорных условий исключающих и ограничивающих ответственность в различных правовых системах и международно-правовых актах.roArticle
